The Dutch court will be suspended for several weeks
The conditions for submitting claims for compensation were communicated to the victims’ families. They must be submitted before February of next year.
The hearings in the case of the crash of flight MH17 in Donbas in 2014 were suspended until 28 September. This was announced on Monday, August 31, by the presiding judge of the case, Judge Hendrik Steinhuis, reports Haarlems Dagblad.
“We are interrupting these hearings until September 28,” he said.
Steinhuis added that relatives of those killed in the MH17 accident must file compensation claims no later than February 1, 2021.
“Regarding the deadline: compensation claims must be submitted before February 1, 2021. The Court considers that these requests will be submitted in a standard manner, which, among other things, must indicate what compensation and payments have already been received by the next of kin of the victims of the tragedy “. , – says the message.
Regarding the right to appear before judges, Steinheis said that the court generally agreed with the proposals made by the legal advisers of the relatives and the prosecution.
In addition, family members will have the opportunity, if they wish, to send written statements to the court.
As Steinheis clarified, family members will first receive the right to appear in court, and only then will the court consider claims for compensation. At the same time, she did not indicate any time frame, noting that everything would depend on the course of the trial.
In conclusion, the judge noted that he agreed with the position of the legal advisers and the prosecution that the court has the necessary jurisdiction to consider a civil claim for compensation payments in the framework of criminal proceedings and that Ukrainian law it should be applied when deciding the question of compensation. He then announced the end of this session and the resumption of hearings on September 28.
As a reminder, today, after several weeks of rest, the Netherlands resumed court hearings in the case of the downing of flight MH17 in Donbas in July 2014.
