Zelensky commented on the unconstitutionality of Sytnik’s appointment
The Office of the President believes that the Constitutional Court gave an evaluation of the administrative decision of the former head of state, and not an evaluation of the quality of the work of NABU.
The President’s Office said that they take into account the Constitutional Court’s decision on the unconstitutionality of the previous president’s decree on the appointment of NABU Director Artem Sytnik. This was announced on Saturday, August 29, by the press service of the Office of the Head of State.
Zelensky pointed out that such a decision is fully within the jurisdiction of the Constitutional Court.
“In accordance with this decision, as we understand it, the judges declared that the ill-conceived, hasty and often speculative practice of staff appointments, which went against the Constitution of Ukraine by forming the most important element of the anti-corruption architecture in the country, it led to the need to make a specific legal decision on unconstitutionality, “says the message.
The office also indicated that the COP provides an assessment of management’s decision regarding staff appointments, and not an assessment of the quality of the body’s work itself.
“Furthermore, the decision clearly emphasizes that the very fact that the appointment of the head of the NABU is unconstitutional, in the opinion of the Constitutional Court, does not deny the reality and consistency of the National Anti-Corruption Office of Ukraine,” the message says.
Zelensky said that in relation to this decision of the Constitutional Court and with a conflict over the possible loss of powers by the director of the Bureau, they hope that the interim director will effectively implement the anti-corruption policy in the period prior to the election of a new leader in honest and transparent competition.
At the same time, the Office of the President expressed its confidence that the NABU will continue to be the central law enforcement body that will ensure the application of modern anti-corruption practices and significantly improve the quality of state anti-corruption policy.
Recall that the Constitutional Court of Ukraine recognized unconstitutional the decree of former President Petro Poroshenko on the appointment of Artem Sytnik as director of NABU.
At the same time, Sytnik will continue to head the department, as there is now no legal mechanism to appoint a new NABU director, said Fyodor Venislavsky, presidential representative on the Constitutional Court.
In turn, NABU said that the decision of the Constitutional Court is politically motivated.
