President Donald Trump discussed the amnesty with advisers to his three eldest children, his son-in-law and his personal lawyer Rudy Giuliani, The New York Times reported Tuesday.
Trump has expressed concern to others that the Justice Department, under the incoming Biden administration, could target his three children – Donald Trump Jr., Eric Trump and Ivanka Trump – and his son-in-law Jared Kushner, who served. A senior White House adviser, the Times reported.
News that Trump is considering pardoning his children came early Tuesday through ABC News.
Constitutionally, presidents enjoy the power of a comprehensive amnesty, with no president yet attempting to grant a pardon for federal crimes committed. The president is legal to pardon family members – in 2001, former president Bill Clinton pardoned his brother in 1985 for possession of cocaine and drug-trafficking.
It is not clear what potential crimes the president can pardon, but the president’s pardon does not extend to state or local crimes.
Trump Jr. was involved in an investigation by former special adviser Robert Mueller into Russian interference in the 2016 election, but he was never charged as a result of the investigation. Giulia was also under investigation by a federal lawyer for his business dealings in Ukraine, which was part of a presidential impeachment late last year.

Last week, the president pardoned his former national security adviser, Michael Flynn, who pleaded guilty to a count of lying to the FBI in December 2017 as part of an investigation into Russian interference in the 2016 election. Earlier this year, Trump also revoked the sentence of former adviser Roger Stone in July.
