The Supreme Court will hear arguments on the House’s request for material from Mueller’s grand jury.

The Supreme Court announced Thursday that judges will hear arguments in the Trump administration’s defiance of the House Judiciary Committee’s attempt to access the secret materials of the grand jury of the Robert Mueller investigation in Russia.

This is a major setback for the Democratic-led committee, which has been trying to access information since the Mueller report came out last year.

While most of Mueller’s report was not redacted, information on grand jury proceedings was kept secret, as the Federal Rules of Criminal Procedure prohibit the disclosure of grand jury information, with limited exceptions.

House Democrats have argued that his request falls under the exception of “court proceedings,” claiming that his impeachment investigation qualifies. They claim that even though President Trump has already been charged and acquitted, his investigation is still ongoing and new articles of impeachment remain a possibility.

So far, his argument has been successful, with a lower court granting disclosure of the information. The Supreme Court, however, has blocked publication of the materials pending its ruling. With the oral arguments set for October, a decision will probably not come until after the November elections.
