Apple will seek damages for allegedly breaching its agreement with the iOS App Store against App Games in a new escalation of the ongoing legal battle between the two companies. The move comes in a filing filed on Tuesday, with unjustified prosperity and a major interference in Apple’s relationship with its customers.
“Epic’s significant disregard for Epic’s commitment to its agreement and other misconduct has resulted in significant losses,” the filing said. “Uncontrolled, Epic’s conduct threatens the very existence of the iOS ecosystem and its invaluable value to its customers.”
Epic Games sued Apple in August after the company’s hit game Fornite Unauthorized payment was removed from the iOS App Store upon implementation of the system. The complaint, filed in August 13, alleges that Apple is violating antitrust laws by using its full control over iOS to obtain commissions for all software passing through the Store.
The filing by Epic comes in full speed response to the initial order filed by Epic over the weekend. Tuesday’s filing provided a lot of protection against that motion. Among other claims, Apple Play said it was commercially fair for all the actions it took, which would claim widespread distrust. “All the time, [Apple’s] The conduct was reasonable and … its actions were carried out in good faith to advance legitimate business interests and had the effect of encouraging, encouraging and enhancing competition, ”the complaint reads.
Apple Play declined to comment in addition to filing.
The recent ruling on the temporary restraining order made that impossible Fornite Will be back to the iOS App Store in the near future. The same ruling ordered Apple to take additional action against another developer’s account used by Epic to support the unrealistic engine.
Epic’s response to Epic’s filing is due Sept. 18 with a full hearing set for September 18.
