A change of power awaits at the White House in Washington DC, but the road is unusually turbulent.
Donald Trump refuses to admit defeat and votes are still being counted in several states. The question on the lips of many people is when the presidential elections in the United States are formally ready, which is not easy to answer.
People have expressed their opinion. Democrat Joe Biden received the most votes nationally and has reached the 270 electoral votes required to be elected President of the United States. However, it is not recognized by Republican President Donald Trump, who has shed light on the formal steps that line the path from Election Day until January 20, when the power shift occurs.
Although Biden is forecast to have won, there is no formal result yet. It may take until January 6 before Trump realizes defeat; This is the way.
November and December: states determine their results
Once all the ballots have been received, the Länder must determine their results. First, it is ensured that every valid vote has been included in the result for every constituency.
In normal cases, this occurs long after the loser has admitted defeat and the media companies have announced through their forecasts who won. But it may take time if the outcome is disputed.
The Trump camp has used legal tools in its efforts to prevent some states where Biden has received the most votes from delivering results, or at least delaying the process. It’s based in part on the idea that if states don’t have time to produce an end result, Republican-controlled state governments can step in and name pro-Trump voters.
However, Chris Galdieri, a political scientist at Saint Anselm College in New Hampshire, doesn’t think it’s realistic.
– It’s a feverish speculation, I don’t think it’s going to happen. Republicans in the states in question don’t seem interested. And several of them have democratic governors that they would veto.
Galdieri does not believe that Trump has any realistic chance of legally influencing the outcome. The campaign’s demands have little or no evidence and most have been rejected in court.
– Furthermore, Biden’s margin of victory is large enough for the election result to stand.
States have different deadlines for announcing their final results, some have already done so while California’s deadline of December 11 expires. The results of the constituencies are sent to the governor, who in turn must present a certificate of the state’s total number of votes and the names of the electors before December 14, when the Electoral College meets. But there is a strong incentive to do so before December 8, the day known as “safe harbor.”
December 8: A safe haven?
This year, the day of the electoral process, which is generally called safe harbor, falls on December 8. Before that, states are expected to have counted the votes, resolved any legal disputes, and submitted the names of their constituents.
If a legal dispute continues after this date, a state runs the risk of not being able to count its electoral votes or the dispute may be decided by Congress.
The Trump camp may still question the states’ results since it was determined, but the courts would likely not take the case, according to The New York Times.
December 14: Electoral College Meeting
On December 14, voters from each state will meet to formally cast their votes for a presidential candidate. The norm is that voters reflect the majority of votes in a state and many states have mandatory laws around them.
However, it is possible to vote differently and on some occasions voters have voted for another candidate. However, these “unfaithful voters” have so far never changed the outcome of the elections.
January 6: Congress approves the result
The newly elected Congress will be sworn in on January 3, and three days later, members of the Senate and House of Representatives in Washington DC meet to count all electoral votes and determine who becomes president.
In ordinary cases, the results established by the states put an end to all disputes. Everything that follows that is usually formalities. But if the state government and governors have designated rival electors, the decision rests with Congress. However, he is expected to declare Biden the winner.
After that, it will be virtually impossible for Trump to persist with claims that he has won and freeze resources for the incoming president.
– It is very possible that Trump will continue his childish behavior until then. Then we have a transition period of just 14 days, which would be terrible considering the situation in the country, says Galdieri.
