Early in the investigation, shortly after the man was arrested, he admitted that it was he who stabbed the man at Heden in central Gothenburg.
However, he denies suspicions of murder.
– You claim self-defense, and it is up to the court to take a position on it, but I am pleased that we have found the person who took the plaintiffs’ lives, Linda Wiking, the prosecutor in the case said earlier.
It was shortly before August 22 of this year that a man in his 25s was found seriously injured in Heden, Gothenburg.
The man had been stabbed in the heart and police and an ambulance were called to the scene, but his life could not be saved.
The man in his 40s sent a text message that went out just before 1 o’clock, a couple of hours after the event.
Ended up in a fight at Frölunda Torg
“I still told him three times I would quit. But after I patted him and gave him two quick low kicks, he snapped. I always have the invisible bull on my jacket cuff, so when he came back I stabbed that bastard in chest and then threw. ”
The victim and the perpetrator had never met before the day in question, but before they were both in Heden, they had met that same night in Frölunda Square.
There, the victim had gone after the suspect, who in turn responded using force after an incident said to have occurred on the tram.
– Something happens before we get cinematographic material, the first thing we have is violence against the applicant in connection with his getting off the tram. Clearly something has happened on the streetcar, the plaintiff going after the suspect is nothing to complain about, but they have not known each other before, prosecutor Linda Wiking previously said.
On Thursday morning, the verdict fell in the Gothenburg District Court, the man is convicted, among other things, of murder, robbery, attempted use of livelihoods and minor drug-related offenses.
The man is sentenced to 12 years in prison.
See alternative courses of action
The Gothenburg District Court states in the ruling that the murdered man followed the perpetrator, but the violence he used exceeds emergency law. The district court convicts him of the so-called attempt at indifference and does not consider the circumstances to be so extenuating that the man should be convicted of murder.
“Regardless of how NN has perceived the situation, the circumstances are such that NN has had the opportunity to take alternative courses of action. For example, he has been able to ask for help or protect himself from (the victim) by distributing non-lethal violence. “
The district court also reasoned on the length of the sentence in light of the change in the law that took effect at the end of the year.
The prosecutor satisfied with the verdict
“The Supreme Court has yet to rule on what the fixed-term sentence for murder should be when the circumstances are neither extenuating nor aggravating. Taking into account all the circumstances of the current case, the District Court considers that the value of the sanction in this case should be set at twelve years. Other crimes for which NN is sentenced do not change the value of the sentence for the total crime “, writes the court
The prosecutor in the case, Linda Wiking, is pleased with the district court’s ruling.
– I think it is a good verdict, it is well written and it passes through the emergency law. It’s well balanced and justifies the length of the sentence, he says.
