The woman has been behind in rents for almost a year, from October 2019 to September 2020. Now the mother of three is getting rid of her apartment in Mölndal.

According to the woman, she had financial difficulties due to late payments from the Swedish Social Security Agency. Despite this, he took a vacation to Spain for seven weeks, falling behind on the rental.

ADHD and mental illness

Before the layoff, the landlord offered the mother to move into a smaller and cheaper apartment.

But in the end, the case went to the rental court, which gave the landlord the right to fire her.

The woman appealed the decision and sent a medical certificate and a statement from the psychologist to the Court of Appeal, which proves that the mother suffers from mental illness and ADHD.

However, the Svea Court of Appeal found that this did not change the matter. According to the ruling, the mother has breached her obligations as a tenant to such an extent that she must be fired. Then your appeal is rejected, writes Hem & Hyra.

Because the woman has three children, the Convention on the Rights of the Child says that additional consideration must be given. But the Court of Appeals still believes that the woman’s obligations are serious enough to weigh more.
