On Monday June 22 at 01.07, a call to SOS Alarm was received from a campsite by Lake Fryken on the outskirts of Kil. The police preliminary investigation report says the elderly man who sounded the alarm got straight to the point:

– I took my dog’s life, I strangled her tonight, she says.

The man’s wife was found dead in the caravan for 50 years.

During police questioning, neighbors told the couple that the man was very drunk that night and that the couple had quarreled before the man strangled his wife. Several neighbors woke up later to the police raid.

The man in his 80s was charged with murder and the prosecutor wanted to see a life sentence.

Released by the Court of Appeal

The Värmland District Court sentenced the man to eight years in prison for murder, which is less than the minimum penalty for the crime. The man received a lesser sentence due to his advanced age.

The verdict was appealed by both the man’s lawyer and the prosecutor.

When the Court of Appeal hearing ended, the man was released pending sentencing.

The decision of the Court of Appeal is based on the fact that they did not consider the man as a danger to escape.

Prosecutor Rebecca Hällgren, demanding that the man be detained pending sentencing, which is normally mandatory for crimes leading to more than two years in prison, said it was an unusual decision.

– I think it’s a strange decision that stands out a bit, Nyheter Värmland then told SVT.

The Court of Appeal confirms the sentence

On Thursday, the Court of Appeals ruled, the district court defends and the man is again sentenced to eight years in prison for murder.

The Court of Appeal, like the district court, notes that the man and the woman fought and that he found himself in an emergency situation, but the force he used was not proportional to the situation.

Thus, the Court of Appeals also comes to the conclusion that the violence that NN exercised against (the woman) and that caused her death was clearly unjustifiable.writes the Court of Appeal in the sentence.

The Court of Appeal considers the murder to correspond to twelve years in prison, but, like the district court, sentences it to eight years and refers to the age and health of the man as special grounds for imposing a lesser sentence.
