Vice President Mike Pence has been said to be furious after the assault on the Capitol on January 6. As hundreds of insurgents were inside the Congress building and, among other things, demanding that Pence be executed for his “treason” in letting the democratic process run its course, Trump tweeted harsh criticism of his vice president. This means that Mike Pence does not intend to activate the 25th Amendment to the Constitution.

The 25th Amendment means that a sitting president who is deemed incapable of carrying out his duties can be removed by the vice president along with most of the government ministers. Democrats in the House of Representatives have demanded that Pence guarantee Trump’s impeachment; otherwise, they will proceed with the indictment of the Supreme Court, whose request was formally presented on Monday.
“The president is an imminent threat to our constitution, our country, and the American people,” President Nancy Pelosi wrote in a statement at the time. In the petition to the supreme court, Trump is accused of inciting rebellion, in connection with the storm.
A vote is likely to take place Wednesday to bring the Supreme Court to the Senate. If it passes, as expected, Trump will be the first president in history to be indicted twice.
The indictment concerns both his unsubstantiated allegations of voter fraud and the speech he gave to his supporters before the January 6 storm. The letter also mentions Trump’s conversations with Georgia Secretary of State Brad Raffensperger, in which Trump urged Raffensperger to “find” the votes he needed to win the Georgia election.
On Tuesday, Donald Trump is expected to go to the Alamo in Texas, to draw attention to the fact that a section of the wall into Mexico has been completed. It will be the outgoing president’s first public appearance since the storm.
