Now the dispute between Midan and the Välbehaget housing association in Hornsberg has been settled in court. The restaurant may remain, but the association will appeal the verdict.

The conflict between the Midan restaurant on Hornsberg beach and brf Välbehaget became national news when it erupted in October last year.
The housing association wanted to finish the restaurant, in part due to annoying noise at night.
In an attempt to mediate, the Midan association offered to stay at the address since the restaurant reduced opening hours and dedicated a complementary room. But he did not accept the owners of Midan.
Now the fate of the Midan restaurant will be decided
Now the dispute has been settled in court and the restaurant is allowed to remain. In the ruling, the district court writes that the restaurant “acted only within the scope of its lease.”
– This is a reckless judgment. The court has not questioned the residents’ testimony or how badly they have measured. The conclusion you can draw from this judgment is that it is okay to disturb anywhere, because this is what rental contracts look like in the city. It is not explicit that it should not disturb the night, says the representative of the housing association Jörn Liljeström about the lawyers of Creo and continues:
– We are of the opinion that this is the wrong balance. The fact that it is not regulated in the lease does not exempt the restaurant from the obligation not to disturb the surroundings. The association will appeal against the verdict.
