A tablet that came loose from its mount and fell to the ground under the brake pedal, just before a cross curve, was the cause of the accident. When the driver attempted to climb the tablet, one of the front wheels of the vehicle landed off the road rails on a bridge over the Berber road. The attempt to backtrack failed and the truck overturned and remained lying at the entrance to the trail. The section of the road had to be closed for almost three weeks for repair.
The tablet was used to receive the driver’s driving orders and was mounted on a bracket between the seats when it was suddenly released. The driver explained at trial that there was a risk that the tablet on the floor would make it impossible to brake before the sharp turn before the start. In that situation, the tanker truck, loaded with 16,000 liters of diesel fuel, could have ended up on a pedestrian and bicycle trail. And if he hadn’t tried to back up when the wheel landed on the railing, there was a risk that the entire vehicle would fall on Carrier Road, the driver explained.
The man was charged with carelessness in traffic, but is now released by the Uppsala District Court. The Court held that there is nothing to contradict the driver’s information that the accident could have had much worse consequences if he had not tried to remove the tablet from the floor. The court also notes that the driver did not drive too fast. The bottom line is that their actions cannot be described as “negligent in the real sense.”
