The painting by Bingo Rimér was initially auctioned to raise money for Musikhjälpen, the photographer and artist writes on his Instagram.
But when he emailed Leif GW Persson to tell him about the painting, the reaction was unexpected:
“I wanted to give Leif a painting as a gift and I thought he would be very happy, and I would love the opportunity that a painting could offer Musikhjälpen in these difficult times. But he was anything but happy. He unexpectedly got very angry and didn’t want to be in a painting with me as a creator.“, Rimér writes on Instagram.
Instead, he was contacted by Leif’s attorney GW Persson, who said the painting would be destroyed and damages would be paid.
“The claim is unfounded”
Bingo Rimér refers to their lawyer, who says they are contesting the claim “in the strongest terms.”
– My client Bingo Rimér feels very sad, he has invested time, money and energy in creating this board and Rimér’s intention has been to donate it to Musikhjälpen in these difficult times. We can’t really understand why Leif GW Persson has such an overreaction, attorney Mark Safaryan tells Expressen.
Despite Bingo Rimér removing the auction board from Musikhjälpen, out of consideration for GW Persson, the demand that it be destroyed still remains.
– That painting must not be destroyed. Bingo won’t destroy the board, it’s a work of art, and it doesn’t violate trademark protection, says Mark Safaryan.
On the other hand, Leif GW Persson’s lawyer Hanna Rosengren thinks so.
“The owner of the trademark has an exclusive legal right to his trademark, which means that no one other than the owner, without his permission, can use the trademark in commercial activities, “he writes in an email to Expressen.
Hanna Rosengren believes that Leif GW Persson has not given permission for her trademark to be used.
“Therefore, we have requested an account of the sale that has been made, if it has occurred, to later decide if any claim for damages should be made,” he writes in the email.
