GW Lawyer: ‘Exclusive right to your trademark’ ● Bingo Lawyer: ‘Dispute the claim’

Bingo Rimér has created a painting that represents the face of Leif GW Persson on a thousand bills.
Now Leif GW Persson, through his lawyer, demands that the painting be destroyed and believes that it constitutes trademark infringement.
– We believe this requirement is unfounded, says Bingo Rimér’s lawyer, Mark Safaryan, to Aftonbladet.
The board with Leif GW Persson, 75, on a thousand crowns bill is in the style of the photographer’s paintings Bingo Rimér, 45, has previously created among others Tim “Avicii” Bergling, Greta thunberg and Zlatan Ibrahimovic and donated to charity.
In the demand letter sent through Leif’s attorney GW Persson now demands that the television profile and crime professor destroy the board and all possible copies, and believes that Bingo Rimér has committed a trademark infringement. They also want an account of any sale of the painting, to decide on financial compensation.

“He got completely angry unexpectedly”
Bingo Rimér writes on Instagram that he sent an email to Leif GW Persson about the board, which was a tribute to him.
“I wanted to give Leif a painting as a gift and I thought that he would be very happy and would love the opportunity that a painting could offer Musikhjälpen in these difficult times. But he was anything but happy. He unexpectedly got very angry and didn’t want to be in a painting with me as a creator. “
The photographer also writes that he is “in shock” after Leif’s lawyer GW Persson’s demand letter.
Rimér’s lawyer: “Unfounded”
Bingo Rimérs Defender Mark Safaryan at the Juristhuset law firm confirms the demand letter to Aftonbladet.
– We have received a lawsuit that Bingo Rimér stop marketing this board, and Leif’s lawyer GW Persson says this constitutes trademark infringement. We do not share that opinion and we believe that it should not be considered a trademark infringement and that Bingo Rimér has had the right to create this board and therefore also the right to donate it to Musikhjälpen. The reason he did not donate the painting to charity was solely out of consideration and respect for the will of Leif GW Persson.
Now they will contest the claim.
– We believe that this requirement is unfounded. It does not apply to the type of business Bingo conducts in its artistic creation. Therefore, we dispute Leif GW Persson’s claims in the strongest terms.
GW Lawyer: “Exclusive Right”
Leif GW Persson is represented by attorney Hanna rosengren at the law firm Björn Rosengren. She comments on their demands in an email to Aftonbladet.
“The owner of the trademark has an exclusive legal right to his trademark, which means that no one other than the owner, without his permission, can use the trademark in commercial activities,” he writes and continues:
“There is no permission for Bingo Rimér to use Leif GW Persson’s trademark in its business and, therefore, we have requested an account of the sale that has been made, if there has been any, to later decide whether to present it. a claim for damages. “
