According to the leaks, it will be Amy Coney Barrett. But there has also been talk of Barbara Lagoa and there has been speculation about as yet unknown candidates. Tonight, President Donald Trump is expected to announce who she wants to see as the replacement for acclaimed liberal Justice Ruth Bader Ginsburg on the United States Supreme Court.

When he received the question from journalists on Saturday night Swedish time, the answer was that he decided “in his own head”. Earlier, Trump said the announcement would come Saturday afternoon local time.

He promised that the next HD judge will be an “extraordinary” woman, and already on Friday, CNN reported with various media outlets, citing Republican sources, which is Amy Coney Barrett, whom the president intends to nominate.

On Monday, the president met with Indiana-based Judge Amy Coney Barrett, and on Friday he met with Barbara Lagoa in her home state of Florida. Both are deeply conservative federal judges who believe that the 1789 constitution should be taken literally. It seems to satisfy morally conservative voters who are against the right to abortion and same-sex marriage and on whose support Trump depends.

In a hurry

Only eight days have passed since Bader Ginsburg passed away and many, primarily Democrats, believe she should be buried before a new judge is appointed. But Trump and the Republicans are in a hurry. This is partly because it is important to ensure that the nine-member tribunal carries conservative weight. After Ginsburg’s resignation, there are three liberal and five conservative justices, but one of the latter occasionally votes with the liberal phalanx.

But the presidential election on November 3 also plays a role. President Trump has hinted that he may not accept the election result and, without providing evidence, has argued that the widespread vote-by-mail that is taking place could lead to voter fraud. If the result is really uniform in one of the so-called crucial wave master states, it can lead to new calculations and demands.

That was the case in 2000, when the entire presidential election hinged on a fair outcome in Florida between Republican George W Bush and Democrat Al Gore. A protracted dispute meant that Bush’s victory with 537 votes was ultimately decided by the Supreme Court.

On the contrary

The swift nomination runs counter to the process that Trump’s own party, the Republicans, advocated four years ago. Then Trump’s Democratic Rep. Barack Obama tried to have attorney Merrick Garland succeed HD Judge Antonin Scalia, who later died. But Republicans, led by Senate Majority Leader Mitch McConnell, emphasized that it was an election year and claimed that the next HD judge would be appointed by the next president, and refused to even question Garland.

The anger of the Democrats has barely abated. But Republicans still have a majority in the Senate, the chamber that questions and approves federal judges. This makes it likely that Donald Trump’s candidate for justice will be approved before the election.
