Lawyers’ behavior hurts an already damaged debate

Some attorneys have recently behaved in a way that damages their body confidence.

Sadly, his indiscretion is being exploited in a debate that leaves much to be desired.

I visited an extensive drug trial yesterday in the security room of the Stockholm District Court, which was forced to take a long break after one of the 23 lawyers involved smuggled out what was supposedly a love letter from his customer stopped.

The Svea Court of Appeal dismissed her for good reasons in the case, as it was not obvious that the letter was harmless. In fact, it could include communication with companions in the wild.

You don’t have to be Sherlock Holmes to understand that the move could have damaged the investigation.

Aftonbladet reveals today that another lawyer after eight months abandoned the law around one of all these gang killings that have plagued Sweden in recent years.

There is a lot of silence surrounding this sudden departure, but so much is known that it happened after the prosecutor leading the preliminary investigation presented a classified letter to the court.

Apparently something serious has happened. Time will probably clarify the image.

It’s starting to seem long, the list of defenders whose judgment deficiencies are as obvious as a drunken mayor who gets caught for doodling.

A music video with a gangster rapper will be recorded in the courtroom. There will be advertising on Instagram for the sound of an automatic rifle hitting. It will be marketed under the abbreviation ACAB (All cops are bastards).

These measures place demands on the Swedish Bar Association, whose actions are not always impressive.

Just remove the evaluation Ali Khan’s lawyer from the family network. He was found guilty of something as serious as doubling the detention restrictions and extracting information.

He received a warning and a fine of 50,000. It is true that it is the second most severe punishment in the arsenal of the disciplinary committee of the Bar Association, but not enough.

The Chancellor of Justice is right that the defender should have been expelled from the organization.

On the other hand, we have the defender who was reminded of a crime as moderate as writing on her private Instagram account during an ongoing murder trial that she missed her children.

The general warning signal is as good as any other. It does not harbor normal emotions, “it can indirectly affect the public’s confidence in the legal profession.”

But there is more than one aspect to these lawyers and their more or less deficient behavior.

Another dimension is that outrageous headlines have been used in the criminal justice debate, particularly by one or two prosecutors who, in their own legitimate desire for a more effective toolbox and harsher punishments, like to sneak into some populist kick to the narrow leg of the bar.

Such things go home in those cabins where the conviction is strong that defenders love crime, make too much money, and drive in fancy costumes roaring back and forth between jails to rid themselves of murderers and rapists.

From time to time, demands arise that the oversight of attorneys should be removed from the community and placed on the state.

That would be extremely stupid. The independence of the defender is stipulated by law. Which in turn is fundamental for a state governed by the rule of law.

The primary role of the attorney is to monitor the individual’s rights against the state, and even a normally gifted twelve-year-old should be able to understand that this review task should not fall under the jurisdiction of the state.

Self-cleaning within the body recalls the ethics of the press and the court of honor. It is not a perfect system, but I have not seen suggestions for better alternatives.

Finally:

Sweden has around 6,000 lawyers who carry out a total of around half a million missions each year. The number of complaints can hardly be counted in a thousand.

That perspective also deserves to be taken into account.
