Labor law: without a deal, it could be a government crisis

The deadline was set for midnight.

But there was no agreement on labor legislation between unions and employers.

Now the government crisis threatens.

Negotiations between unions and employers on labor legislation crashed late Thursday night, both at the Swedish Business Confederation and at the state LO for Aftonbladet.

– There will be no further negotiations tonight, says Malin Fagerberg Wikström from the LO press service.

Mattias Dahl, Deputy Executive Director of the Confederation of Swedish Business, regrets that there is no agreement.

– There have been many concrete proposals for a better functioning labor market at the negotiating table. We have done our best to find a balanced arrangement that the three parties could bring home. Unfortunately, we have not succeeded, he says in a press release sent shortly before 02 o’clock.

Deadline September 30

Negotiations took place between LO, the Swedish Business Confederation and PTK, a collaborative organization of 27 unions organizing salaried employees from the private sector.

The parties themselves had set September 30 as the deadline for a deal.

– The negotiations have been constructive despite many difficult problems. In the end, we were sadly forced to say that we didn’t find a deal that everyone could accept, says Mattias Dahl.

Negotiations have focused, among other things, on exceptions to the LAS priority rules, the Employment Protection Act and what should be counted as a factual basis for dismissal for personal reasons.

Exceptions to the “last in, first out” principle have been an important topic in the negotiations.

The investigation occurred on June 1

The changes in the labor legislation are one of the points of the January agreement between the government and C and L. On June 1 an investigation was appointed and presented to the government. Among the researcher’s proposals is that five employees can be exempted from the priority rules, compared to the current two.

Jonas Sjöstedt and V have threatened several times to leave Löfven if the investigation becomes law.

On the same day the investigation ended, Prime Minister Stefan Löfven criticized it.

– We have asked for an investigation, which establishes both the order of priority, the balance between the parties and that we should not have arbitrary dismissals. Then a researcher receives an assignment and presents his proposal and now we say that the balance between the parties has not been maintained, he told Aftonbladet.

The government crisis threatens

Löfven and the government have high hopes that the social partners will agree. When the negotiations now fail, the ball ends up with the politicians.

Under the January agreement, the investigation will become law in 2021. However, investigator Gudmund Toijer set January 1, 2022 as the start date.

The unfolding of events increases the risk of a government crisis. The Las investigation was a concession to the Center Party and the Liberals, who therefore demanded that it become law if the parties do not agree.

At the same time, the Left Party has repeatedly said that it is willing to overthrow the government if the proposals become law. On Wednesday, KD leader Ebba Busch said she was ready to back V on a no-confidence motion against Löfven.

– First of all, it is well known that we are in favor of a reform of the – but we also believe that Sweden needs a new government. If this gives us the opportunity to do so, then we will not hesitate, said in Aktuellt from SVT.

The leader of M, Ulf Kristersson, and the leader of SD, Jimmie Åkesson, have previously delivered the same message.
