Three different prosecutors active in western Sweden had reported the lawyer to the disciplinary committee of the Swedish Bar Association. When the board’s decision was announced on Thursday, it was clear that he would be punished with the second harshest measure in the Bar Association’s arsenal: a warning and a fine of SEK 50,000.
The next step is exclusion from society, but the disciplinary committee did not go that far.
– It surprises me a bit because if they came to the conclusion that he has committed a restriction violation in two cases, I saw in front of me that it would be so serious that they would exclude him, says prosecutor Daniel Larson, who wrote the first report to the Bar Association .
The three events which is the basis of the complaints, has in common that the lawyer was accused of violating good legal practices by helping alleged criminals to evade the restrictions that have been imposed on them during their detention.
The disciplinary committee of the Bar Association writes in its decision that “on two occasions in a relatively short time it has committed serious violations of good legal practices in the way of acting in violation of the restrictions announced to clients.”
In two of the cases, the Gothenburg lawyer has represented people with strong ties to organized crime. For several years, he has been repeatedly hired by a family in northeast Gothenburg, which is home to a large group of people who have been singled out by the police as one of the most influential criminal networks in the city.
Gothenburg lawyer has in one such case, he helped his client in a way that makes it possible, according to prosecutor Daniel Larson, that he helped the defendant fabricate a false alibi.
– What I am reacting to in particular is that the investigation would not justify its actions taking place with the intention of trying to influence any investigation against clients. But in my case, he must have understood that because he contacted a possible alibi witness and provided information, says Daniel Larson and continues:
– That it would not affect the investigation, that he as a lawyer does not understand it, it is more or less that the Bar Association rejects his ability to understand such basic things. It is very strange to me that this did not happen with the intention of influencing any investigation.
Together with In the second gang-related case, the attorney was accused of having helped three brothers from the family network in the Northeast to dialogue before trial in a major drug case, despite the fact that all three were in custody and did not know each other. allowed them to have contact with the outside world. In that case, the lawyer is acquitted by the disciplinary committee.
– I have made a report and I support it, but obviously they have made a different assessment and believe that it is not possible to prove it. I still think these are very serious things, says chamber prosecutor Ulrika Bentelius Egelrud of the national unit against international and organized crime in Gothenburg.
The third case concerned a serious financial crime and this time the lawyer is said to have helped a man arrested and later convicted to write a letter to a bankruptcy administrator on behalf of his wife.
Daniel Larson believes that the man should be excluded from the Swedish Bar Association and thus lose the opportunity to work as a lawyer.
– I find it difficult to see anything else because there are two serious violations of this with the restrictions. If you don’t deal with such basic things, it feels like you’ve used up all your confidence.
