The legal process began when the police authority revoked the man’s gun license last year after previously depriving him of his hunting weapons, two shotguns and a shotgun.
Police argued that the man’s connection to a motorcycle club he supports and is located in the vicinity of Hells Angels meant the weapons could be misused. The man did not buy into that reasoning and said, among other things, that the decision was contrary to freedom of association.
When the case was brought to the Karlstad Administrative Court, the man was right and the police decision to withdraw his weapons permit was reversed. But now the highest court, the Gothenburg Court of Appeal, has expressed its opinion: the police did well to withdraw the man’s weapons permit.
Connection with Hells Angels
In the ruling, the Court of Appeal relies, among other things, on previous judgments concerning members of Hells Angels and Bandidos whose firearms licenses were revoked and their weapons revoked. The court believes that the fact that the man was until last year at least a member of a motorcycle club subordinate to Hells Angels means that his weapons permit should be revoked when he “remains and actively participates in an environment in which he does not they must produce firearms. “
The verdict establishes, among other things, that the man was observed in the courtyard of the Hells Angels club in Karlstad, where a member of the club was killed with a crowbar and a tarp in the winter of 2017. A crime for which two men from Hells Angels are imprisoned for life.
The fact that the man received a sanction order for minor drug offenses last year also contributes, the court argues.
The man himself has claimed that he left the current motorcycle club. But the court concludes that “there is no support for that task.”
Can be appealed
According to the Court of Appeal, the decision does not contravene the freedom of association or the prohibition of discrimination according to the European Court, which defended the man.
The decision can be appealed to the Supreme Administrative Court. It is the highest instance that only grants permission to appeal “if it is important for the management of law enforcement that the appeal be tried.”
