The man who was sentenced in district court to life in prison for murder and violation of public order now receives a reduced sentence.
The Western Swedish Court of Appeal sentences the man to 18 years in prison.
The man, who had a relationship with Wilma, was convicted on July 27, 2020 for murder and disorderly conduct by the Uddevalla District Court. The district court found that the man had violently killed Wilma in their shared apartment and then seriously injured, mutilated and disposed of her body. The victim’s head was found in a closet in the apartment.
The sentence was life imprisonment.
Aggravating circumstances
Like the district court, the appellate court convicts the man for murder and disorderly conduct. The Court of Appeal conducts largely the same assessments as the district court as to what has been investigated into the incident. However, the Court of Appeals considers that part of the description of the crime regarding the nature of the violence that caused his death has not been proven.
The Court of Appeal considers, as does the district court, that the offense has included many aggravating circumstances.
But, according to the Court of Appeal, the murder has not been shown to have taken place without the man’s intention. Nor has it been possible to investigate in more detail the extent of the violence and the course of events.
Agree
In an overall assessment, the Court of Appeal, based on the legislation in force at the time, has concluded that the circumstances have not been so aggravating that there are grounds for life imprisonment. The circumstances, on the other hand, have been so aggravating that the penalty for the crime must be set at the maximum prison sentence of 18 years.
The Court of Appeal agrees with its ruling.
