Court lifts Huawei ban on 5G auction

At the end of October, the Swedish Post and Telecommunications Agency (PTS) decided to close the door to Chinese products Huawei and ZTE on Swedish 5G networks. The assessment of both Säpo and the Swedish Armed Forces is that the Chinese company represents a security risk.

The Administrative Court has ruled that Huawei has the right to appeal the decision and that the parts relating to Huawei will cease to apply until further notice.

– It’s a surprising message. Partly because it comes very close to the auction, but also because one might think that a Swedish authority should be aware of what it has the right to do in such cases, says SVT technology correspondent Alexander Norén.

– Now the ball is in the court of PTS, which must decide whether they can appeal the decision of the Administrative Court to the Court of Appeal, continues.

“There are no good conditions”

The announcement means that Tuesday’s 5G auction will likely be postponed. The companies that have previously been allowed to participate in license auctions in the 3.5 GHz and 2.3 GHz bands are Hi3G Access (Tre), Net4Mobility (Tele2 and Telenor), Telia Sweden and Teracom.

– There are no good conditions to start such a large auction when it is not clear who can bid. Several of the telcos have Huawei equipment on their 4G networks and it means a great cost to them if they have to switch to the 5G network, says Alexander Norén.

Several countries, led by the United States, have banned Huawei’s 5G expansion equipment. This after allegations that Huawei has close ties to the Communist Party of China. The fear is that the Chinese government could steal valuable information through the company’s technology. Huawei has categorically denied that the company had ties to the Chinese government.

SVT Nyheter has asked Energy Minister Anders Ygeman (S) for a comment, but to no avail. The Swedish Armed Forces tell SVT that they are analyzing the message and will make a statement shortly.
