It was in 1973 that the Supreme Court established free abortion in the United States with the ruling in the case Roe v. Wade. Would abortion rights be overturned if Donald Trump succeeds in appointing a new conservative HD member following the death of liberal member Ruth Bader Ginsburg this weekend? Millions of social conservative Trump voters hope it is the result of a swift appointment process.
Favorite candidate Amy Coney Barrett is perceived by many Americans as encouraged by resistance to abortion. Barrett, 48, is a judge on a federal appeals court that covers three states in the US Midwest. She is Catholic and (at least previously) a member of a small Catholic congregation, the People of Praise, which has embraced the languages of the Pentecostal Church and the laying on of hands.
Barrett and her husband he has seven children. One of the children was born with Down syndrome, which arose from a fetal diagnosis during pregnancy. Two of the children are adopted from Haiti. In addition to his demanding job as a Court of Appeals judge, Barrett volunteered at the boys’ elementary school in South Bend, Indiana.
She received her law degree from the renowned Catholic University of Notre Dame and served as a notary for Antonin Scalia, a legendary conservative member of the Supreme Court who died at the age of 79 in February 2016. To have served Scalia is great merit in this context. Scalia was considered an outstanding representative of “originalism”, the school that seeks to interpret the constitution literally. Barrett is a disciple of Scalia in that sense.
The combination of the life of a little boy In the Midwest, Notre Dame’s higher ratings and Scalia’s experience make Amy Coney Barrett a favorite of Trump and a right-wing Republican. It’s the Senate in Washington DC, where Republicans have a majority, which would confirm Barrett. For her to be a woman would suit the male-dominated party: Ruth Bader Ginsburg, the liberal she would replace in HD, was a feminist icon who in the 1970s, as a lawyer, helped women and men become more equal before the law.
A candidate would possibly make the confirmation process a little less shaky. Trump’s former court candidate, Judge Brett Kavanaugh, was charged at the end of the trial with harassing women in his youth, when he was partying. Kavanaugh’s appointment involved people far beyond the United States. It became a dramatic method in concentration, highlighting the diametrically different attitude of the two sides to allegations of sexual harassment.
But a dating process by Coney Barrett would also involve Americans in general. Already when it was confirmed before the Court of Appeals in 2017, Coney Barrett was crowned as a legal celebrity among religious conservatives. A liberal senator from California said during the trial that Coney Barrett was guided by her religious beliefs. “A dogma lives strong within you,” Senator Dianne Feinstein told the incoming judge. Coney Barrett’s Catholic fans endorsed the words and printed the phrase on T-shirts and mugs, just as Kavanaugh supporters later printed her Senate defense speech, “I Like Beer,” on their clothing.
It is not certain that the appointment of Coney Barrett will immediately repeal the national right to abortion. In a speech at a Florida university in 2016, Coney Barrett said HD was unlikely to run over “Roe v. Wade.” Most likely, Coney Barrett said, state abortion legislation will gradually relax with several minor bugs in HD. It could be, he said, the possibility of having an abortion late in pregnancy or how many restrictions a state can place on abortion clinics.
From a liberal point of view Coney Barrett is perceived as a serious threat to the Affordable Care Act, Obama’s health care reform that the Trump administration is trying to repeal. The purpose of “Obamacare” is, among other things, that all American citizens in one way or another are connected to health insurance. The Affordable Care Act will be tested in an HD case as early as November. This is another reason why Trump and the Republicans in the Senate want to try to appoint a conservative member of the HD even before the November 3 presidential election.
Trump has said he will announce a name on Friday or Saturday this week.
