Last summer, the Vänersborg District Court sentenced a man, who at the time of the crimes was a member of Bandidos, to one year in prison for 12 cases of fraud and one case of aggravated reception. It is said that today he left the organization.
That verdict will be rendered in the Court of Appeal in December when the man appealed.
In a letter to the Court of Appeal, the man’s attorney, Mia Sandros, writes that “there were circumstances that could alter confidence in the impartiality of board member Marie Dahlin in the district court trial.
In an emailed comment, Mia Sandros writes that it is ultimately a matter of public trust in the judiciary. “Everyone has the right to a fair trial and my client does not feel that he received it,” he writes.
Marie Dahlin (S) was previously the chairperson of the municipal council in Vänersborg municipality and in her role commented negatively in various articles about Bandido’s establishment in the municipality.
The convicted person alleges inconsistency
In articles, she has said, among other things, that “It should be difficult to be Bandits in Vänersborg Township” Y “I think these people should not be allowed into the pub if they wear vests.”
The fact that Marie Dahlin had an engagement with Bandidos before is, according to the convict, a conflict of interest situation, since she did not announce it.
“The circumstances undermine confidence in Marie Dahlin’s independence and impartiality in the case. What has emerged about Marie Dahlin shows that she is an active debater and actress on issues related to Bandits and, in particular, the Bandits establishment in Vänersborg “.
The lawyer also mentions the collaboration that the municipality of Vänersborg entered into with the police and the merchants association Forum Vänersborg in 2015, to assist the establishment of the criminal organization of motorcyclists, which Marie Dahlin faced in her role as president of the Municipal board.
Marie Dahlin herself believes that this was in no way a conflict of interest situation.
– I feel like it was very implausible, it was also many years ago. I don’t feel like I have a conflict of interest situation, he says.
“Bandits are not a person”
She says that as a city councilor at the time, she was active against the establishment of Bandidos, but to draw the conclusion that it would be unfair since individual members of Bandidos are being tried several years later, she wants to go too far.
– I had no idea who the people were and I haven’t put any names in memory. For me, it is wrong if you have knowledge of someone, and Bandidos is not a person that I know, he says, but he still welcomes a test of the subject.
The man’s lawyer, Mia Sandros, believes that it is possible that Marie Dahlin’s ambition was to be able to differentiate between organizations and individuals, but she returns to the fact that ultimately it comes down to the public’s trust in the judiciary and wants let the trial resume.
Anders Hagsgård, President of the Court of Appeal, says that the Court of Appeal department must now investigate the objection to the dispute. If they find it to constitute a conflict of interest, the case may be returned for a new trial in district court.
– This is a question that the Court of Appeals must deal with, he says.
The current case is from 2016 and that’s when it was decided in district court this long overdue summer.
