At the end of last year, former cross-country star Anna Holmlund traveled to Spain for a rehab camp. It was described as an important step on the way back after the horrific accident in 2016, which left her brain injured.
“I have returned home after three wonderful weeks in Alicante. Very good with training, psychology and a lot of fun”Holmlund wrote on Instagram when he returned to Sweden.
Subsequently, she and her family applied for compensation to the Swedish Social Security Agency for expenses of around 150,000 SEK. But they were rejected.
The judgment of the Administrative Court
The reason: the current care was not offered by his home region, Västernorrland.
– The other colleagues from the field in other places of residence have been paid everything, explained Lars Holmlund in an interview with Aftonbladet this spring.
According to him, Anna Holmlund would have been paid if she had lived, for example, in Västra Götaland, Stockholm, Halland, Östergötland, Skåne, Jönköping or Kronoberg. Therefore, an appeal was filed.
But now it has been rejected in the Administrative Court.
It is indisputable in the case that Region Västernorrland would not have offered Anna Holmlund the care she has received in Spain. The question then is whether the corresponding care would have been possible for the public to pay for it using free choice of care. “, writes the Administrative Court in its sentence.
You can appeal to a higher court
They also write: “The Administrative Court finds that Anna Holmlund has not shown that she could have received the current care paid for by the public using free choice of care. What Anna Holmlund has stated that the decision of the Swedish Social Security Agency is contrary to the principle of equality for all before the law and the objectives of the Patient Mobility Directive does not give rise to any further assessment. Therefore, Anna Holmlund is not entitled to compensation for the expenses she has incurred in connection with the care at issue in Spain in the case. Therefore, the appeal must be dismissed “..
When SportExpressen comes to Lars Holmlund, he explains that this was not the decision they expected.
– But we haven’t made a decision yet, what to do with this. You can either accept it or get upset again and appeal to a greater distance, he says.
– We must evaluate whether it is reasonable, possible and appropriate to appeal. We have not taken a position yet, but we will do so in the next few days.
