Kim Eriksson Sirawan, 39, was transferred from Thailand’s torture prison to Österåkeranstalten two years ago.

But he has applied to avoid the “mentally exhausting” Swedish prison service by having to serve the rest of his sentence in Thailand.

But now the prison service has made a decision on the matter and rejects the Swede’s wish.

Swede Kim Eriksson Sirawan was arrested after a raid on his garage on the outskirts of Bangkok in the summer of 2010.

In the garage, the police found a drug lab and 53 grams of methamphetamine.

The punishment became the most severe in Thai law: death.

But Kim Eriksson Sirawan was pardoned and sentenced to 36 years in a Thai prison.

Inhuman conditions

He spent the next eight years in infamous terror institutions like Bambat Phiset, Klong Prem, and Bang Kwang, describing the conditions as inhumane.

But two years ago, Sirawan was approved to serve the remainder of his sentence in a Swedish prison. The sentence was commuted to 18 years in prison when he arrived in Sweden. But the Swedish Prison and Probation Service decided to add three years and three months to an earlier sentence. Something for which he felt unfairly treated.

He cannot study or meet his daughter

After a year and a half of clashes with the Swedish authorities, the Supreme Administrative Court ruled that the total sentence should be 21 years and three months.

But despite her long struggle, Kim Eriksson Sirawan recently requested to return to a Thai prison.

In a handwritten letter, sent from Österåker prison, he states that the purpose of serving the remainder of the sentence in Sweden two years ago was “that a transfer is supposed to improve the conditions for the social reintegration of the convict.”

The Swede ends the letter by writing:

“Thai prison care is certainly characterized by physical torture, but equal treatment is complete and constant. The unfair Swedish prison practice is psychologically exhausting and I find it more difficult to bear. I am disappointed by the promises of the agreement and given that The Swedish Prison and Probation Service blatantly ignores my special situation and ignores the nature of the crime compared to the sentence I have already served, I request to be transferred back to Thailand. “

The Swedish Prison and Probation Service has made a decision on the issue of Kim Eriksson Sirawan’s return to Thailand. And they reject it.

In their decision, they refer to the International Cooperation Law on the Execution of Criminal Sentences (IVL) and Sweden’s bilateral agreement with Thailand.

However, IVL and the agreement with Thailand do not allow the transfer of Thai judgments from Sweden to Thailand.
