Are the digital meetings of municipal politicians up to the legal requirements? Not always, according to the Administrative Court, which overrules all decisions made at two of the Luleå city council meetings in December.
The Administrative Court declares in the ruling that it is possible and permissible to allow members to participate remotely in council meetings. But there are some requirements on how this is done.
“Participation must be carried out through audio and video transmission in real time and in such a way that all participants can see each other, hear each other and participate in equal conditions,” writes the Administrative Court.
During the ongoing meetings, on December 21 and 22, 2020, the court claims, however, that remote participating members have not been able to see the physically participating members in the meeting room. At the meeting on December 21, 2020, the image connection also stopped working for a member participating in the distance.
“They constitute such deficiencies that the decisions taken at the meetings cannot be considered to have been taken in a lawful manner. Therefore, they must be revoked ”, writes the Administrative Court.
Attorney Victoria Bäckström comments on the verdict:
“Since the matter has not been tried before, it can also be tried by a higher court. Our assessment is consistent with the interpretation made by the Swedish Municipalities and Regions.”
