The 26-year-old man was fatally stabbed in the back in connection with a fight at Landvetter in February. A 25-year-old man who was previously convicted of the murder is now free, local media report.
The Gothenburg District Court sentenced the man to 12 years in prison this summer, but the Court of Appeal ruling, which was issued on Tuesday, breaks that decision.
At the same time, the acquittal of a boy in his thirties who was also accused of murder is maintained.
According to the Court of Appeals, it is not possible to prove which of them stabbed the 26-year-old, who died of his injuries that same night.
District Attorney Lotta Nielsen is disappointed with the Appeals Court’s reasoning.
– I am not satisfied, but they have been too cautious in their evaluation. I have a witness who recounts what he saw and heard and maintained his information through the district court and the court of appeals, he tells GT.
– But the Court of Appeal decided to acquit both despite the fact that it has been proven that one of the suspects committed the crime, but not in agreement. I’m disappointed.
