The dispute concerns a house on a lake plot east of Uppsala. The leader of the Christian Democrats party, Ebba Busch, believes she has bought the property. But the owner, a man in his 80s, says he quickly regretted it, felt pressured to take the deal, and therefore didn’t close it, as Expressen was the first to say.
Now Ebba Busch has the Uppsala District Court decide the matter. On Wednesday, a lawsuit was filed in court where she wants the deal to go through.
– We will respond and then we will wait for an oral preparatory hearing in the district court, where there will be an opportunity for conciliation between the parties. Otherwise, there will be a hearing in the district court, says the owner’s legal representative, Johann Binninge.
It all started at the end of June when Ebba Busch contacted the owner through intermediaries. They met on August 20, signed an agreement that she would purchase the property for 3.9 million SEK and she transferred a down payment of 390,000 SEK.
According to the agreement, the access date was September 16. They would then close the deal at Swedbank, write a purchase letter with the signatures of two witnesses, and send it to the National Land Survey to obtain a legal right to the property.
However, the man regretted on August 21, according to Johann Binninge, he wanted to cancel the deal and had difficulty remembering certain parts of the process.
– He has serious memory problems and says he was pressured to sign the purchase contract, regretted it and tried to contact her later. Then there is the question of what you remember and don’t remember. He thinks this is terribly difficult, says Johann Binninge.
But Ebba Busch denies and you believe that people with financial interests in the property have pressured the owner not to leave the house. According to her, they agreed to the sale after the August 20 meeting, but they believe that he changed two weeks later after strong pressure and that a relative of hers wanted to defame her in the media.
– Since the man, through a third party two weeks after the purchase, announced that he wanted to cancel the purchase, I have tried to meet with him and his legal representative without success. We have entered into a correct and legally binding contract and, despite this, I have been willing to discuss different solutions to the situation. Nine weeks have passed and there has been no interest in discussing a solution. There are several things that need to be resolved, says Ebba Busch.
This Tuesday would be a meeting between the parties is in the hands of the lawyer of the KD leader in Uppsala. The owner showed up with a colleague, but left after a discussion about whether the colleague would be allowed to participate, says Johann Binninge, who would participate in a telephone link.
However, the other party believes that they did not have time to comment on this before disappearing.
– My client said he just wanted to come in and say he didn’t want to sell the property and then leave. I have a hard time understanding what the meeting would be about because he has made it clear that he does not want to sell the house. Ebba has also said in the media previously that he would back down if my client did not want to sell, says Johann Binninge.
At the same time, Ebba Busch has not yet received the initial payment of 390,000 SEK. According to Johann Binninge, this is because they have not been given a bank account number.
The lawsuit, which is now before the Uppsala District Court, states that the man, in case of conviction, must pay a fine of 400,000 Swedish crowns if he does not sign all the documents that are the basis for obtaining the legal title of the property.
This is an old man and Ebba Busch is a party leader. How far are you willing to take this and can it affect you as a political leader?
– Of course, the fact that you have now chosen to carry out an action can affect the image of it in the media. My client’s decision to sue now has been considered a last resort, says his attorney Katrin Björklund.
