But the neighboring municipalities of Malmö and Lund have opted for completely different interpretations, according to documents that the licensing authorities of each municipality have extended to restaurants with service licenses.
In the letter Malmö’s permitting unit states that the temporary ban covers all servings of spirits, wine, strong beer and other fermented alcoholic beverages or other “preparations similar to alcoholic beverages”. The prohibition applies from 10pm to 11am and the place of service must, in the Malmö interpretation, be vacated at 10.30pm.
Businesses that only sell soft drinks or popular beer are not covered by the ban, writes the city of Malmö, which also announces that supervision will be strengthened.
Municipality of Lund He writes that “there is much uncertainty about what should be applied in practice during the prohibition period.”
The Lund licensing authority has opted for a completely different interpretation than that of Malmö.
“No alcoholic beverages other than popular beer can be on the tables after 10.30 pm when the consumption of alcohol (other than popular beer) must be completely completed as clearly as if the guests had left the room,” writes the municipality of Lund.
With the interpretation of the Lund Municipality, guests will be able to stay as long as the restaurant normally has a service permit. Many restaurants in Lund have a service permit until 01:00, which means that guests do not have to leave until 01:30.
The municipality of Lund has been the reference body in the work on the ordinance and pointed out ambiguities regarding both the popular beer service and the evacuation times. But despite the accusations against the government, Lund does not feel he has received clarification.
– Of course, we take the intentions behind regulation very seriously, as do our restaurants. From what we can see, serving popular beer after 10pm is not prohibited, says Annika Landfors, permitting manager in Lund Municipality.
She points that the ordinance explains what alcoholic beverages are prohibited after 22, but that popular beer is not mentioned, and still not mentioned after a referral from Lund.
– All municipalities have question marks, he says.
