But HD has decided not to grant relief in the case.

– This is not over now. We have not given up in any way, says attorney Marko Tuhkanen, who is already planning the next termination request.

In November 2014, a man was beaten to death and his partner was subjected to aggravated rape in the village of Rönnäs in Västerbotten.

Carpenter Lars Appelvik, 48, was found guilty by a co-suspect. But before the trial took place, the co-suspect withdrew the entire story.

There was no technical evidence linking either of the men to the crime scene. Still, they were sentenced to 11 years in prison.

HD: did not meet the requirement

Aftonbladet published a lengthy report on the Rönnäs case in connection with Lars Appelvik’s submission of his termination request at the end of August.

On Monday, the Supreme Court announced that it will be rejected.

The short motivation is:

Lars Appelvik has not shown any circumstances that could cause an uprising in the case.

Three unanimous judges made the decision.

– Here, several new circumstances were brought forward, so there was an absolute reason to dig a little deeper into the review. Both from the previous verdict and to put it in connection with what was presented now, says Kerstin Calissendorff, one of the judges.

HD does not consider it likely that the Court of Appeal would have reached a different result or a lighter criminal classification had it had the information that Lars Appelvik highlights in his request for redress.

– It did not meet that requirement, which is quite a high requirement, says Judge Kerstin Calissendorff.

Nor was it considered that there were any other reasons for reverting to the question of liability.

The prosecutor opposed the uprising

In September, HD requested a prosecutor’s opinion on Lars Appelvik’s request for redress.

Prosecutor Petra Lundh was not convinced by the new circumstances that emerged. The notification stated, among other things, that the Public Ministry opposed the granting of a precautionary measure and that the Public Ministry had no intention of resuming the preliminary investigation.

In response, Lars Appelvik and his lawyer Marko Tuhkanen have submitted an opinion to HD. First of all, the lawyer believes that there are interrogations that link another aggressor to the scene.

But HD followed the same line as the prosecutor.

– The fact that the Supreme Court has not understood these circumstances gives me fear, disappointment and sadness. I know we have an innocent convict, says attorney Marko Tuhkanen.

Planning the next mounting application

In several criminal cases noted above, the Supreme Court has denied the first request for termination and then granted the termination.

That Teittinen, represented by Marko Tuhkanen, received a court order the second time she applied. Kaj Linna was granted an erection in the Kalamarks case only through her third request for an erection.

Later, Teittinen and Linna were released. Marko Tuhkanen will continue his work for Lars Appelvik to become one.

The lawyer says it won’t be many months before the next termination request is filed.

– There are several experts that I have not referred to now. In the end, it is a question of costs, now we have to bear all these costs ourselves. I was hoping the state would take over here, but now it didn’t happen. But they must also know who they are dealing with. As long as I know that Lars is innocently locked up, I’ll be a nail in the eye. They will come to feel that, says Marko Tuhkanen.

Appelvik: “Wants an explanation”

Lars Appelvik himself is disappointed and upset by the message from the Supreme Court. Also, on top of that, they don’t give any justification for the decision.

– There are new circumstances and I would like an explanation of why they did what they did. But it’s just to keep going. Nothing else can be done, says Lars Appelvik by phone from Skogomeanstalten.
