Dick Nord’s disability means that he is on the intellectual level of a young child.
She cannot express herself in words and needs help 24 hours a day not to worry.
In December 2017, Dick was placed in a group home in the Gothenburg area. During his stay at the residence, Dick was exposed to threats and rapes, SVT Väst revealed early last year.
Dick’s aunt, also a good man, noticed early on that everything was not as it should be and shared her concerns with the accommodation manager, staff and owners, who thought everything was fine.
The verdict falls on Monday
She was not satisfied with the answers and finally decided to place a hidden recording equipment in Dick’s room. What he heard then overcame his worst fears.
– I had to turn it off because I couldn’t hear. I couldn’t play it for my mother, because I didn’t think she could do it, the aunt told “Assignment review.”
The audio recordings include how parts of the staff threaten Dick with physical punishment, and at one point they pour water on him.
A person who has worked in the accommodation has been tried on suspicion of harassment in a situation involving a duffel bag. Staff have put a duffel bag on Dick, then sit on the sack himself, according to suspicions.
On Monday afternoon, the verdict fell against the former employee of the residence who is sentenced for harassment to a suspended sentence.
Will pay damages to dick
“NN (the caregiver) has not yet appeared on the debit record. Restlessness is not a crime of such a nature that the normal punishment is imprisonment. Since there is no particular reason to fear that NN is guilty of a continuing crime, the penalty will be determined by a suspended sentence. ” writes the district court.
On the other hand, the caregiver does not have to pay a daily fine, which is common in a suspended sentence. But when the man lost his job, the district court decided not to rule on the matter.
The district court writes in the ruling that the testimony of the caregiver’s colleague gains support from what is heard on the recording. During his testimony, the colleague said, among other things, that he saw that Dick was terrified and feared for his life.
“The accusation has been substantiated and must be confirmed. NN will be convicted of harassing Dick Nord according to the prosecutor’s accusation. ”
The caretaker must also pay SEK 15,000 in damages.
Massi Fritz: “An important verdict for many”
– We are on the plaintiff’s side and many of us are satisfied with today’s district court ruling. The district court’s ruling is very clear. This is an important judgment for many. Few cases of this type lead to prosecution. We need to raise the issue of legal certainty for disabled plaintiffs, says Ellisabeth Massi Fritz in an email comment.
She goes on to say:
– You have been in a particularly vulnerable situation. I can not speak. It can even defend itself less from an attack. The applicant has been completely dependent on the staff of the accommodation, which is his home. It is important not to forget that. My client has been raped very seriously and suffered great suffering.
The caretaker’s attorney, Mats Dahlgren, claims the verdict did not turn out as he intended.
– We have to consider the verdict. I will review it with my client and decide if we should appeal. I note that the district court has ignored the objections it had about the emergency defense and the emergency law, respectively, which is unexpected, he says.
