On March 3, Johan Fröberg, 53, died from lack of oxygen to the brain. Eight days had passed since his throat was cut in a brutal act, in his own home.
It was February 24 and Eva Fröberg, 43, was in the kitchen of her and her husband’s home in Västerås. Suddenly he heard a scream from inside one of the children’s rooms. She ran there and saw her husband holding her neck.
Eva: “It was horrible”
– It was terrible. I ran to the neighbor and asked him to call an ambulance. There was blood everywhere, says Eva Fröberg.
Today he no longer remembers blood. She “remembers everything, but not the blood,” she says.
She recalls how she tried to help her husband, who had a towel pressed against the open wound.
– I said: “You have to fix this for our children. They need you, they love you. You have to fix this for our good. “
– I’ll never forget your anxiety. This cry remains, says Eva Fröberg.
I had family together
She and her husband got together in 2007, they got married in 2012. Together they had two children. The children have been placed in a family home for the past two years, but the couple struggled to get them back.
– It wouldn’t end like this. The idea was to get our boys back. One of them had just started to be a father and called him “papa el rey,” says Eva Fröberg.
It is the two children who make her have the strength to continue fighting.
– That’s what I’m living for right now, otherwise I probably would have given up.
Tommi Marttila convicted of murder
Tommi Marttila, 46, known to Eva and Johan Fröberg, has been convicted of the murder. He appeared at the couple’s home to look for a phone when he suddenly “struck a chord,” according to his own statement in court. Then he took out a knife that he had brought with him and cut Johan Fröberg from behind on his neck.
The district court sentenced Marttila to life in prison for murder. It relied on a tightening of the homicide clause that took effect at the end of the year and pointed to two aggravating circumstances in the case:
On the one hand, the victim was subjected to severe suffering and, on the other hand, the act was considered especially ruthless.
NEW LEGISLATION
On January 1, 2020, the penalty for murder was increased.
Previously, the normal sentence was 14 years in prison. He was sentenced to life imprisonment in aggravating circumstances.
With the tightening of the law, the intention is that the majority of murders will be punished with life imprisonment.
So far, the Court of Appeal has interpreted the increased punishment to mean that the normal punishment for murder should be 16 years in prison. The Attorney General wants the Supreme Court to try him now.
The reasons for life after adjustment can be:
that the act was preceded by careful planning, characterized by a special proposal, aimed at promoting or concealing another crime, entailed severe suffering for the victim, or was particularly ruthless.
• Murders that previously landed 15-18 years in prison are now considered to carry life in prison.

But the Svea Court of Appeal reduced the sentence to 18 years in prison. The court held that “conditions of a mitigating nature” also existed. Among other things, that the act was not planned, but rather an “impulsive act”.
Historical essay in HD
The Supreme Court (HD) has now granted permission to appeal in the case, after both prosecutor Petra Lundh and Tommi Marttila appealed the verdict.
This will be the first time the stricter HD murder legislation has been tested.
According to Petra Lundh, the murder had the “execution character” and now she wants Marttila to be sentenced to life imprisonment.
“In my opinion, there are no extenuating circumstances in this case. I must point out that the absence of an aggravating circumstance (for example, that the act was not planned) can hardly be considered mitigating.”he wrote on his appeal.
Eva Fröberg also wants her husband’s murderer to be sentenced to life in prison. He is happy that HD is taking over the case.
– I won’t get Johan back, but he (Tommi Marttila) will find out. You took the life of my husband and you have no right to take the life of another person. He can sit there and feel this every day, like me, he says.
It has been recognized
Marttila has admitted that she took the life of her acquaintance, but denies the intention to kill.
According to his lawyer Björn Andersson, who wants to see a shorter prison sentence, there are other extenuating circumstances.
– Especially around the person of my client. He has been in such a situation around his mental state and more, which could have been considered an extenuating circumstance.
Tommi Marttila has been previously convicted, among other things, of robbery, assault and unlawful intrusion. He suffers from mental problems and substance abuse, according to a statement from the probation service.
