In early September, Gothenburg lawyer Edip Samuelsson, representing the Ali Khan family, where several members were identified as a criminal network, received a warning and a fine of SEK 50,000 from the disciplinary committee of the Swedish Bar Association.
The reason was that he was found to have violated good legal practice and had been reported by three prosecutors in western Sweden for helping clients circumvent detention restrictions and disclosing information.
The Bar Association convicted him in two cases, but acquitted him in the third. The disciplinary sanction is the second most severe punishment; exclusion is the most severe.
Prosecutor: “Too lenient punishment”
At the time, Chamber Prosecutor Klaudia Mathé of the Gothenburg Economic Crimes Authority felt that Samuelsson should have been more harshly convicted and excluded from society.
It is too lenient a punishment, he thought.
The general secretary of the Bar, Mia Edwall Insulander, justified the decision not to exclude Samuelsson, which had meant a professional ban for him:
– The action came after a serious error of judgment on the part of the lawyer, it was not to intentionally damage the investigation, he said.
Now the Chancellor of Justice, JK, is appealing the decision to the Supreme Court, they wrote on his website.
“He seriously breached his duties as a lawyer”
They demand that Edip Samuelsson be excluded from the Swedish Bar Association.
In the claim, they write:
In summary, AA (Edip Samuelsson) seriously violated his obligations as a lawyer on two occasions by transmitting information in violation of advertised restrictions to his clients. In the opinion of the Chancellor of Justice, there are strong reasons to continue to take seriously the fact that an attorney abuses a rule that is as important to the legal profession as room privilege. Therefore, the Supreme Court must change the decision of the disciplinary committee and exclude AA from the bar association. “
I don’t want to comment
Edip Samuelsson himself does not want to comment on the Chancellor of Justice’s appeal:
– I have nothing to say. Thank you very much.
The city of Gothenburg and the Swedish state have donated hundreds of thousands of crowns in contributions to the Ali Khan family network association over several years.
