The Svea Court of Appeal is now reversing the district court’s ruling and sentencing two men for the shooting in Råcksta on August 28 last year, when 18-year-old Ndella Jack was killed. The Court of Appeal sentences two men to prison for aiding and inciting murder and aiding and inciting an attempted murder.
The 23-year-old man who is now convicted of the shooting is also convicted of aiding and inciting an assassination attempt in a shooting in Sickla on September 8 last year. Therefore, he receives 16 years in prison. The 30-year-old man who is now sentenced in the Court of Appeal is only convicted of the Råcksta shooting and is now sentenced to twelve years in prison.
The district court ruled that the two men could not be linked to the crime scene in Råcksta. The Court of Appeal now makes a different assessment and “concludes that in weighing the investigation presented by the prosecutor, it is [det] put beyond reasonable doubt that men have participated in assassinations and assassination attempts eg. get a getaway car and take a position with the weapons used, ”according to a press release.
With regard to the Sickla shooting, the Court of Appeal in principle makes the same assessment as the district court.
– This is a case with indirect evidence, the so-called clues, says the president of the Court of Appeals of the court, Camilla Olsson in the press release.
She continues:
– The Court of Appeal makes an overall assessment of the evidence and also considers that the investigation shows that there is a very strong connection between the events of Råcksta and Nacka when the same automatic weapon was used and the same person was the target on both occasions.
The Court of Appeal also rules two other men previously acquitted, one 30 years old and one now 39 years old, for attempted aggravated firearm crime and firearm crime, respectively. They are sentenced to one year and four months and two years in prison respectively.
The trial against the total of four suspects began at the Solna District Court at the end of April, of which a 23-year-old and a 30-year-old were charged with the murder of 18-year-old Ndella Jack in Råcksta on 28 April. August 2019. Another man, also a 30-year-old, was charged with attempted murder in the Sickla shooting just over a week later. Another man, now 39, was a suspect in a felony firearms crime.
But the two murder suspects were not convicted by the Solna District Court for the murder in Råcksta. However, according to the district court, the 23-year-old could be linked to the scene of the Sickla shooting and was sentenced to eight years in prison for aiding and abetting an assassination attempt. The 30-year-old who was charged with attempted murder in Sickla was also acquitted. The 39-year-old was also acquitted at the time.
The people involved they are known criminals who have been previously convicted and, according to the police, have been part of a criminal gang that was later affected by an internal conflict.
According to prosecutor Maria Hävermark, the gang conflict that led to Jack de Ndella’s death began at his wedding. Friends of the criminal network are suspected of turning on each other after a wedding conflict in The Gambia. Offended and threatened, two of the men are suspected of opening fire with automatic weapons at the apartment in Råcksta, after which the target’s wife, 18-year-old Ndella Jack, was shot. Her husband, a 33-year-old man on heavy criminal charges, escaped the bullets at the same time.
Little more than a week later In the fatal shooting in Råcksta on September 8, the 33-year-old survived another assassination attempt when he was shot in a residential area of Sickla. During this shooting, when an automatic weapon was also used, two innocent outsiders were injured by passed bullets. On the one hand, a taxi driver received several blows to the back but survived the injuries. He told DN about the experience:
– I felt something hot and wet on my back and felt like it exploded in my body. I remember five shots that I got, he said in October of last year.
A 23-year-old music student was also met, who at that time was more than 100 meters from where the shots were fired. The student was shot in the eye and lost his sight due to injuries.
The news of Ndella Jack’s death also shocked many in his hometown Fisksätra in Nacka Township. There, the mosque, the church and the House of the People were open so that the mourners could meet.
In September it was brought Ndella Jack on her last rest in the Älta cemetery. Many mourners gathered. There were also a large number of police officers at the scene who feared further attacks against her husband.
Ndella Jack’s father, Pa-Modu Jack, told DN after the funeral that his first reaction was pure surprise when the message reached him about what happened to his daughter.
– The first time I heard that he had died, I fell to the ground.
She got the message from Ndella Jack’s new husband.
– He told me he tried to save his life, but couldn’t.
