Special Prosecutor Dan Webb reported “substantial abuse of discretion and operational failures” in Cook County State Attorney Kim Foxx’s treatment of Jussie Smollet’s case.
Webb, who was commissioned to investigate, released his findings on Smollet’s case and Foxx’s treatment on Monday. He writes that Foxx and those who worked with her made false statements, which were later shared with the public regarding Smollet’s dismissal.
In January 2019, The Rich star came under fire for inciting suspected racist and homophobic attacks against himself. He was charged with 16 crimes on March 16, including one for submitting a false police report following the January incident.
Webb’s report goes on to say that Foxx and her staff have shown potential ethical concerns in their handling of the case. However, the prosecutor could not find any criminals in Foxx’s treatment.
Mark Geragos, Smollett’s lawyer, responded to Webb’s report. He wrote that the report confirms that “there was no wrong or unreasonable influence by Jussie” as his dismissal.

“This so-called ‘report’ on Kim Foxx and the timing of Jussie’s charges revealed the real political election motivation of Dan Webb and his cohorts. It’s a blatant attempt to take down a black, progressive, female prosecutor who does not fit. in the white power structure.Jussie, a black, gay man who maintains his innocence, is constantly used as a pawn.Today’s report confirms what the defense has said along the way – there was no crime or disproportionate influence by Jussie or the defense in the dismissal of all the prosecutors against him and the second wave of prosecutors is a blatant constitutional violation. “
