The submission was made Monday by New York, 48 other states, Washington, DC, and several other territories against Purdue Pharma and other distributors and manufacturers, according to New York’s attorney general. A financial breakdown per state provided in the court case shows that New York is trying to claim $ 165 billion.
An official with knowledge of the submission acknowledges that it is unlikely that anyone will recover this high-dollar figure.
Purdue has repeatedly denied crimes and said in response to the submission that the claims were expected.
“On July 30, Purdue successfully launched one of the most comprehensive comment campaigns in the history of Chapter 11,” Michele Sharp, executive director of media relations for Purdue Pharma, said in a statement. “Purdue continues its work to recover from bankruptcy, gain additional support for the proposed scheme, and implement a final resolution. The proposed scheme would provide more than $ 10 billion in value, including 100% of Purdue’s assets, to claimants. and communities, and would address the opioid crisis by providing essential funds, such as millions of doses of the opioid addiction rescue treatment and overdose reversal drugs. “
As part of the court filing, U.S. Centers for Disease Control and Prevention cited opioid data on deaths from 1999-2018. New York saw 3,050 deaths in 2018. Death rates were adjusted to reflect a CDC formula for several reasons of underreported opioid deaths, according to the official.
The New York lawsuit against all opioid manufacturers and distributors was set to begin in April, but was postponed due to coronavirus. Purdue was previously a suspect in the case, but because it filed for bankruptcy, the claim was moved to bankruptcy court.
Oklahoma was not included in the $ 2.15 trillion claim because of its previous settlement with several companies.
