The Guimarães Court of Appeal sentenced a teacher from a Braga school to four and a half years in prison, who sexually abused a 14-year-old student.
By means of a judgment of October 12, consulted today by Lusa, for the suspension of the sentence, the teacher must pay the victim compensation of 12 thousand euros.
The defendant was convicted of 10 crimes of sexual acts with a teenager.
In the first instance, the Court of Braga had sentenced the accused to three years in prison, for the crime of sexual abuse of a dependent minor, subsequent treatment, and the payment of compensation of 8,000 euros.
The prosecutor and the victim’s father appealed, demanding penalties of at least four and a half years in effective prison and, in the case of the second, compensation of not less than 50,000 euros.
The case dates back to the 2016/2017 academic year, with the accused being a Physical Education professor at EB 2.3 of Cabreiros, in the municipality of Braga.
The defendant, who was 48 years old at the time of the events, was also the director of the victim’s class and an advisor to the school’s Chess Club, which the student attended.
Often the two were left alone in the room.
The court confirmed that the teacher “began to approach” the victim as of January 2017, after a party that the students organized for him on his birthday and a race that took place in Guimarães.
He began to contact her through Facebook ‘Messenger’, which “made her feel more affectionate for him.”
In a chess class, and after an alleged bet with the youngest, which she lost, the teacher kissed her on the mouth.
From then on, the abuses would happen every Friday, when the accused was alone with the student, in the chess club.
However, there were meetings between the two in a store operated by the accused and at the home of the student’s godparents, who were emigrated.
In May 2017, after the student’s classmates made their relationship with the teacher public, she would have asked the youngest not to tell anyone, so as not to harm her career.
At the trial, the professor confessed the facts and regretted, but affirmed that it was a “mutual attraction”, without threats or aggressions, so the relations between them were “consensual.”
He said there was an “emotional involvement” that he could not put an end to.
A version corroborated by the youngest, in the statements he had made for future memory.
The court considers that the teacher’s behavior “deserves censure” because “he was old enough to be the father” of the victim but he did not refrain from seducing him and “abusing his innocent feelings and his inexperience in life”, practicing with him, 10 times, relevant sexual acts ”.
However, and given the absence of a criminal record and the family insertion of the accused, the court considered that it was “possible and opportune to suspend” the sentence, but with the condition of compensating the minor in an amount that would allow him to meet therapeutic expenses that are considered necessary for their development and maturity also in the field of interpersonal relationships.
The court added that the amount of the compensation must also allow the minor “to enjoy the circumstances of life that she likes – and that money has the possibility of satisfying – and allow her to turn the page of her emotional life, definitely, by doing it. of the vulnerability and naivety with which he had the deformed sexual experience in which he was involved ”.
After this case, the accused was subject to a disciplinary process, which culminated in his expulsion from teaching, but he appealed the decision, the case being before the Administrative and Fiscal Court of Braga.
The defendant now sells diet products, and is also a sports assistant at a gym.
