A BOLA – TAD annuls Palhinha (Sporting) decision with yellow card

The Court of Arbitration for Sports upheld the appeal presented by João Palhinha against the decision of the Disciplinary Council of the Portuguese Football Federation regarding the yellow card received by the Sporting player in the match with Boavista on January 26.

In the sentence to which BOLA had access, it can be read: “Declare the present appeal on the omission of the plaintiff of the disciplinary offense foreseen and sanctioned in article 164, paragraph 7, of the RDLPFP, due to the sub judice absence of the alleged factual objective typical of which such commitment depends, consequently annulling the appealed disciplinary sanctioning decision, with the acquittal of the offender for whom he was disciplined with suspension of 1 (one) game and a fine of € 153.00 (one hundred and fifty-three euros) .

Palhinha, it is recalled, appealed the sanction claiming nullity of the disciplinary decision due to depreciation of the rights of hearing and defense, but the Arbitral Tribunal rejected this point as unfounded. Yes, the testimony of the arbitration college of arbitrator Fábio Veríssimo on the candidacy in question was taken into account.

“Due to my position at the time of the play, it led me to act with discipline because I considered that the Boavista player was free of opponents and ready to shoot on goal when he was pushed by Sporting’s player number 6. After looking at the images of the movement (angle opposite my position) I consider that it does not meet the criteria for a promising attack. Therefore, the disciplinary action was not appropriate ”, it is quoted.

In view of the decision, the Court also determined that the costs of the procedure will be borne by the Portuguese Football Federation.
