Police have charged a California woman with murder after giving birth to a stillborn baby. Now the state’s attorney general is condemning it


Chelsea Cheyenne Becker, 26, delivered a stillborn child on September 10, 2019, which medical professionals believed may have been exposed to drugs while she was pregnant. The death was ruled a murder after an autopsy by the Kings County Coroner’s Office found methamphetamine in the baby’s system, police said.

Becker has been in prison since November 2019 and is currently awaiting trial. Her bail is set at $ 5 million. The superior court rejected Becker’s motion to dismiss the prosecutors in June.

“Our laws in California condemn women who suffer the loss of their pregnancies, and in our submission today we make it clear that this law has been abused to the detriment of women, children and families,” Becerra said in a statement.

“We will work to end Ms. Becker’s persecution and imprisonment so that we can focus on applying this law to those who endanger the lives of pregnant women.”

Becerra added that he believed the law was “misapplied and misinterpreted” and argued in short that a woman could not be prosecuted for murder as a result of her actions leading to a loss in pregnancy.

He also refers to section 187 of criminal law, which he said should not be used to punish women who, due to addiction or lack of resources, are unable to exercise prenatal health. The intent of the code was also not to “punish women who may be desperately trying to terminate their pregnancies,” according to the brief.

Kings County Attorney Keith L. Fagundes told CNN that his office was not informed that the Attorney General would file an amicus letter.

“This case is not about a stillbirth, it is a case of an overdose of a mother of a viable fetus in the late term,” Fagundes said.

“I appreciate the opinion of the Attorney – General, and can only conclude that he has not been properly informed of the facts of this case, has not read any police report and has the medical information involved in this particular case, not checked. “
