§ 4. Suitability

Health personnel must carry out their work in accordance with the requirements for professional soundness and care that can be expected based on the qualifications of the health personnel, the nature of the work and the situation in general.

Health personnel must adapt to their professional qualifications, and must obtain assistance or refer patients when necessary and possible. If the needs of the patient so require, the professional practice should be carried out through collaboration and interaction with other qualified personnel. Health professionals have a duty to participate in work with an individual plan when a patient or user is entitled to such a plan in accordance with the Law on the rights of patients and users § 2-5.

In collaboration with other health personnel, the doctor and dentist must make decisions on medical and dental matters, respectively, regarding the examination and treatment of each patient.

The Ministry may stipulate in the regulations that certain types of health care can only be provided by personnel with special qualifications.

§ 10. Information to patients, etc.

The person who provides health and care services must provide information to the person who is entitled to it in accordance with the rules of the Law on Patient and User Rights §§ 3-2 to 3-4. In health institutions, the information after the first sentence should be provided by the person designated by the health institution.

The Ministry may, through regulations, issue additional provisions on the duty to provide information.

§ 39. Duty to keep a record

The person providing medical care shall record or record the information as mentioned in section 40 in a medical record for the individual patient. The obligation to keep a medical record does not apply to collaborating health personnel who provide assistance following instructions or guidance from other health personnel.

In health institutions, a person will be appointed who will have overall responsibility for the individual medical record and, in doing so, will take a position on the information to be included in the patient record.

The Ministry may, by regulation, order the health personnel mentioned in the first paragraph to keep their own medical records that the patient keeps by himself (his own medical records).

§ 40. Requirements for the content of the magazine, etc.

The record will be kept in accordance with good professional practice and will contain the pertinent and necessary information about the patient and medical care, as well as the information necessary to comply with the duty to notify or the duty to provide information stipulated by law or in accordance with the law. The medical history should be easy for other qualified health personnel to understand.

It must be stated who entered the information in the record.

The Ministry may, through regulations, issue additional rules on the content of the patient record and the responsibility for the record in accordance with this provision, including on the storage, transfer, termination, delivery and destruction of the record.

§ 74. Use of protected title

Only those who have an authorization, license or approval from a Norwegian specialist in accordance with section 53 are entitled to use a professional designation that characterizes the group of health personnel in question. This also applies to those who had a specialist authorization, license or approval until expiration due to age, see section 54, first paragraph.

Personnel who have the right to practice their profession as medical personnel temporarily in Norway without the authorization, license or approval of a Norwegian specialist, may use the professional designation used in the country in which they are established, in such a way that the title is not confuse with the corresponding Norwegian title. Staff who are entitled to practice the profession as a doctor, medical specialist, dentist, dental specialist, nurse, midwife or temporary pharmacist in Norway without the authorization, license or approval of a Norwegian specialist, may use a Norwegian professional designation.

The right to use a Norwegian degree also has other personnel who have the right to practice the profession as health personnel temporarily in Norway without authorization, license or approval of a Norwegian specialist, if the Norwegian authorization authority has verified the professional qualifications of the person .

No one may misuse titles or advertise businesses in such a way as to give the impression that they have an authorization, license or approval from a specialist.

The Ministry may, through regulations, establish additional provisions on what titles are protected under this section.
