The 21-year-old was a passenger when the car crashed. The driver (20) is now charged with causing wrongful death.
The car accident occurred in Ervikveien in Åsane, near Tertneskrysset, around 10:00 p.m. on Sunday, April 14 last year.
The car must have been first on the road on the left side and then hit a concrete feature on the other side of the road.
Robin Erstad Rødlyng (21) died in the accident. He died on the spot, according to police.
A year and a half after the accident, the prosecutor has issued an indictment in the case, police lawyer Kjersti Katrine Svendsen confirms to BT.
– Important sign
Svendsen says that three young men who were in the car must appear in court. This applies to the driver (20), another 20-year-old man who sat in the passenger seat and a man (19) who sat in the back seat.
The three are accused of fleeing after the incident, without checking the condition of the most seriously injured. For the driver, this charge is applied for having left someone in a defenseless state, while the other two must answer for not providing assistance.
– This is an important signal to give, that passengers can also take responsibility if they simply escape without checking that someone else who stays is doing well, says Svendsen.
She will be the prosecutor when the criminal case goes to court.
Must have driven 104 km / h
In questioning the day after the accident, an 18-year-old man admitted that he had driven the car and that he ran away after the accident. According to Svendsen, the prosecution assumes that the driver maintained a speed of 104 km / h in zone 50 at the scene of the accident.
He also did not have a driver’s license, according to police. The charge also applies to driving under the influence of alcohol and drugs.
– On the part of the driver, it is a mixture of intoxicants that corresponds to more than 1.2 per thousand. All of the defendants were under the influence of drugs, police attorney Svendsen told BT.
The most serious charge against the driver, wrongful death, carries a maximum penalty of six years in prison.
– This accusation means that he caused the fatal accident, says Svendsen.
The section corresponds to what used to be called “motor vehicle homicide”, but the new penal code does not specifically mention vehicles.
There were six people in the car and all of them must be from the Åsane area. In addition to the deceased and the three men now charged, two other young men were also present: a man who is now 22 years old and a woman who is 20. The two were transported to Haukeland with serious injuries, and both are said to have undergone surgery.
In the indictment against the driver, the injuries of these two are also included through a separate indictment under the Road Traffic Act.
– He lost his son
Jan Bakke is an assistant attorney for the deceased’s parents. Said this:
– They have lost their son and it still weighs on them. They are happy that the case is now making a decision. They are waiting for the case to be decided by the court.
Two of the defendants, including the driver, have not yet been appointed defenders, according to police attorney Svendsen.
The driver: Incredibly sad
BT has been in contact with the accused driver. The 20-year-old says the case has affected him a lot both mentally and physically, especially recently, and that the accident is something he thinks about all the time.
He says he hopes to have an advocate in such a serious case.
– It’s incredibly sad what happened. I’ve been waiting for a year and a half and I hardly heard from the police. But I will defend what I have done. At least none of the others in the car are at fault for the accident, the 20-year-old tells BT.
The youngest of the accused, the 19-year-old riding in the back seat, is represented by lawyer Torbjørn K. Sognefest. On Wednesday, the defender declined to comment on the charge against BT.
BT has been in contact with the third man accused, but does not want to comment on the case either.
