The oldest Supreme Court Justice Ruth Bader Ginsburg died Friday night at the age of 87. She was appointed a Supreme Court Justice by President Bill Clinton in 1993.
Now the question is who will take his place and whether the decision will be made before or after the presidential elections on November 3.
It is the president who appoints the judges of the Supreme Court and the Senate that approves them. And Donald Trump will act quickly.
– it will be a woman
– I want a ready candidate next week. It will be a woman, he said during a meeting in Fayetteville on Saturday.
The Senate, where Republicans have a majority, will decide on the president’s proposal before the presidential election, says Senate party leader Mitch McConnell.
But several Republicans believe that you have to wait until after the election. Democrats believe it too. And Ruth Bader Ginsburg said, shortly before she died, that you have to wait to nominate a new candidate until after the election.
Barrett and Lagoa up
Trump wants a conservative candidate. In a phone conversation with Mitch McConnell this weekend, he is said to have singled out Amy Coney Barrett (48) and Barbara Lagoa (52) as two favorites, according to US media. They are currently judges in the federal appeals courts.
Amy Coney Barrett was born in New Orleans and worked as a law professor at Notre Dame Law School before becoming a judge. He has been on Trump’s current candidate list since 2017. Barrett is a practicing Catholic. She is an outspoken opponent of abortion, and they have wondered if this will affect her position when these cases are heard in the Supreme Court.
Barbara Lagoa was born in Miami and is the daughter of Cuban parents. She was the first of Latino origin to be convicted by the Supreme Court in her home state of Florida.
Two other justices, Amul Thapar (51) and Allison Jones Rushing (38), will also be part of a small group of candidates Trump is considering. Thapar should be Mitch McConnell’s favorite.
– Highly respected
They are all nominated by Trump for the positions they hold today, and they should have strong support among conservative lawyers who have given Trump advice in such cases.
This weekend, Trump described Barrett as “highly respected.” When asked about Lagoa, he replied that “she is a very special person, I have heard a lot about her, she is highly respected.”
In September, former leaders presented Trump with an updated list of 20 names of people they think will be relevant as future conservative candidates for the Supreme Court. At that time, there were no vacant seats on the Supreme Court.
Both Barrett, Lagoa and Thapar appear on this list, along with Republican Senators Ted Cruz, Tom Cotton and Josh Hawley. Other names on the list are Gregory Katsas, Kate Todd, Christopher Landau, Paul Clement, and Noel Francisco.
