Police investigators wanted to re-arrest murder victim Tom Hagen when he was released from Oslo prison on Friday afternoon, but the state prosecutor stood firm.

This confirms Attorney General Kirsti Guttormsen to NRK.

– It is an important principle that the tax authority must follow the decisions of the court. And then, depending on the circumstances, I thought it was okay not to arrest him immediately after his release, Guttormsen tells NRK.

Tom Hagen was released from Oslo prison on Friday afternoon after being detained for more than a week. The murder charge is confirmed, but Hagen was released after the trial court ruled that police evidence failed to provide the alleged reasonable grounds to suspect murder or complicity in the murder of his missing wife, Anne-Elisabeth Hagen.

According to NRK, any new arrest would have to occur as a result of entirely new evidence, presented after the Court of Appeals handled the case.

Police appealed the ruling, but it was rejected on Friday in the Supreme Court. They wanted to detain Hagen for four weeks with letters and bans on visitors.

Outfield defender Svein Holden has so far not responded to VG’s questions on Saturday.

– I am concerned that the investigative management has made that decision. Secondly, I am sure there is an active public prosecutor in the case who makes sure that the police relate to what I believe to be the correct law, Holden told Dagbladet.

In a press release on Friday, police wrote that they were making the decision and that the investigation was continuing.

“Therefore, we relate to the decision of the Court of Appeal that the basis for custody of Tom Hagen is considered absent now,” Prosecutor Haris Hrenovica said in the press release.

Following the Court of Appeals decision, police made another arrest Thursday: a man in his 30s from Romerike, charged with murder or complicity in the murder of Anne-Elisabeth Hagen. The man rejects the criminal charges.

The man was expected to be detained on Saturday, but defender Dag Svensson denied this to VG on Saturday morning.
