– My client wants to move home and sleep in his own bed, says defendant Svein Holden.

On Wednesday, it was announced that murder victim Tom Hagen will go to the police to challenge the records they are carrying out at his residence in Sloraveien in Lørenskog and at the cabin in Kvitfjell.

From the Lower Roman District Court there were indications that the decision could come as soon as Wednesday, but Nettavisen will confirm on Wednesday night that the final decision will not be available until Thursday after 2:00 p.m.

Therefore, the garden has just under a day of excitement ahead.

– I believe that the Criminal Procedure Law grants rights to everyone. The police cannot enter your residence. That is why we have disputed this and withdrawn it in court, Hagens defender Svein Holden tells Nettavisen.

Client Hagen has a strong desire to return to his own home, which he has not had access to since he was arrested in late April.

– The police have carried out a series of investigations into Sloraveien in the last 18 months. When he was released, he had a desire to move home and sleep in his own bed, Holden says.

Wife Anne-Elisabeth Hagen, who has been without a trace since October 31, 2018, is charged with murder or complicity with this.

Tom Hagen has repeatedly denied criminal charges.

Last week, the Eidsivating Court of Appeal ruled that there are no reasonable reasons to suspect murder or complicity. On Friday, he was released in Oslo. At half past five in the afternoon, he opened the prison doors like a free man.

However, the police believe that his house has been murdered and that it is a crime scene. They also still have searches there.

Criticizing the police

The prosecutor for Hagen’s three children, Ståle Kihle, is highly critical of the police who conduct searches when the Court of Appeals has ruled that there is no reason to believe that Hagen likely had something to do with the murder.

– There is no reason to trust the police. They have been blind and have tunnel vision. My clients’ confidence in investigative leadership in the Eastern Police District is weak at best, “Kihle told Nettavisen.

The Eastern Police District has been criticized, but does not want to comment directly.

Earlier Wednesday, they said in a press release, after Kihle criticized the police in the media. Even then, he said he believed the police had tunnel vision in the investigation.

In simple terms: They are not investigating other possibilities that Tom Hagen has helped kill Anne-Elisabeth.

– From the beginning we have investigated the case extensively and followed the traces that we have found. It has been, and is, a demanding investigation, especially since we believe that someone has deliberately entered to deceive the police. Police have a special responsibility to ensure an objective investigation, East Idaho Police Chief Melbo Øystese said in the press release.

Although we have charges, the investigation is as much about corroborating as it is about confirming, and about providing evidence of both guilt and innocence. I am sure that the investigation will be carried out in a good and objective way.

Late Tuesday night, Kihle also told VG that the children are refusing to go to further interrogations.

Anne-Elisabeth’s lawyer for assistance, Gard Lier, believes it is to the advantage of anyone who knows something about the case and can help clarify it at the disposal of the police. He emphasizes that there is no criticism of children in any way.

– I think they have given many explanations earlier in the case. But if they or others have information that can help the police come up with a solution, then it is an advantage if they help, Lier tells Nettavisen.

– Anything that can help the police will be of interest to Anne-Elisabeth.
