NHO believes that you should now be prepared to make changes to your summer vacation settlement.

– The Korona pandemic represents an extraordinary situation, which for many companies means unusually high uncertainty regarding operational challenges and future conditions. Times are unpredictable and both employer and employee must be
flexible so that we can make the most of the challenges. Therefore, we must be prepared, among other things, to make changes to the summer vacation settlement, Nina Melsom, director of work life at NHO, tells TV 2.

In a letter, which has been given access to TV 2, to the Ministry of Labor and Social Affairs, the NHO has requested that the provision of the Vacation Act be amended.

On April 20, the response came from the government, where the ministry claims that the Vacation Act already has considerable leeway.

Ragnhild Nordaas, Deputy Head of the Ministry of Labor and Social Affairs, tells TV 2 that changes to the Holiday Act have been discussed at the Labor and Pension Policy Council, chaired by the Minister for Labor and Social Affairs, Torbjørn Røe Isaksen. Parties to the labor market also participate here.

“The bottom line is that organizations are encouraged to resolve any challenge with the vacation administration under the current vacation law,” Nordaas told TV 2.

In a letter to the parties, the ministry writes that the Vacation Act already has considerable leeway.

Change planned vacations

The Ministry believes that in the Vacation Act there is an opportunity for the employer to change the stipulated vacation.

The law states that fixed holidays can be changed “because unforeseen events will create major operational problems and no substitute can be obtained.”

– The Ministry assumes that, as a result of the covid-19 situation, events may arise that are not foreseen at the time of the determination and, therefore, could provide the basis for changing the stipulated vacation. The ministry assumes that
This may be the case, for example, in the case of sudden absence of high illness, employees who have to go into isolation / quarantine or who change infection councils provide a basis for resuming operations, according to the letter from the Ministry of Work and Social Affairs.

Melsom at NHO says it may be wise for the vacation to end before activity resumes.

– For many companies, there is, among other things, uncertainty about how long the layoffs will last in the company. Activity in many industries is also likely to pick up later in the year. This means that it may be desirable to vacation
It will be finished sometime beforehand so you don’t have much left when the activity resumes, the NHO director tells TV 2.
