It was Dhenujen Yogathas (13) who died after a collision in Oslo on Thursday.

This is what the family lawyer, Morten Engesbak, tells Dagbladet.

The man who is charged with negligent manslaughter after driving on the 13-year-old at Haugenstua in Oslo on Thursday, was booked for imprisonment on Saturday afternoon.

The man admits to having driven the child, but does not admit criminal guilt for driving under the influence of drugs.

Ask for release

The prison meeting began at 12:15 pm on Saturday and just ended when Dagbladet spoke to the defendant’s defender, Harald Fjeldstad, on Saturday afternoon.

Police lawyer Anne Cathrine Aga informed TV 2 today that she would request that the man remain in custody for four weeks.

– Now we have to wait until the verdict is written, later this afternoon. We ask that he be released, or subsidized release against reporting duty, Fjeldstad tells Dagbladet.

He says that the client acknowledges the facts, but maintains that it is an accident.

– Explain that you have taken drugs at the beginning of the day. Blood tests will show whether or not he has left the body, so it is too early to say whether he was under the influence of drugs or not, he says.

You say your client is having a hard time.

– It was terrible for him to know that the child died, but he understands that it must be worse for his family. He has young children himself, so it is not difficult to understand how difficult they must be.

Accused of negligent homicide

On Friday night, police arrested a man in his 30s after the collision. He is now charged with violating the Highway Traffic and Negligent Homicide Act.

The arrested driver of a dark Mitsubishi SUV admitted under questioning to having been at the scene Thursday night, approached the pedestrian and left the scene. He was detained in his own home after good police work. Operational teams managed to locate him, and we believe we have the right perpetrator, Rune Skjold, head of finance investigation and specialized letter investigation in the Oslo police district, told Dagbladet.

On Friday, Dagbladet received confirmation that the defendant was previously under investigation in another criminal case, which involves driving under the influence of drugs.

– When did this relationship happen?

– Not long ago, without my being able to give more details. Therefore, we want to stop him in danger of recidivism, Skjold said.

The earlier crime did not involve personal injury, the head of the investigation said.

– You explained that you left the place because you panicked. He also justified this by saying that he saw other people at the scene and that he was sure the boy would get help. Of course, there is no excuse for him not to stop, but it says something about the fear he was in at the time, his defender Harald Fjeldstad told Dagbladet on Friday.

He said his client admits to using drugs or alcohol earlier in the day, but was unaffected at the time of the crime.

– Then the blood tests will reveal if you were affected or not. The same will do the additional investigation to see if you were negligent when you drove the child. He himself has explained that it was an accident.

The defender continued:

– It is important for him to emphasize that he thinks this is terrible and of course the worst for the family, with whom he expresses his deepest condolences. You are in dire straits.
