Rejected with a phrase

The verdict left little doubt. A unanimous Supreme Court, including Trump-appointed justices, rejected an attempt to change the outcome of the Pennsylvania election on Thursday night Norwegian time.

The Supreme Court has been Trump’s last chance to be declared the winner of the election.

Republicans in the state have argued that the widespread use of vote by mail is unconstitutional, but they have not been heard. They wanted the 2.5 million votes-by-mail cast or regional authorities to determine the state’s electoral delegates.

Joe Biden won the state election with around 80,000 votes.

The verdict is in one sentence:

“The demand on the intervention presented to Judge Alito and referred by him to the court has been rejected,” writes the Supreme Court.

Nor is there anything in the ruling to indicate widespread disagreement. In the United States, Supreme Court justices can request that their arguments for or against a decision appear in the judgment itself.

So even the judges Trump himself has chosen – Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett – don’t seem to agree that he won the election.

– The fact that the judges have rendered a verdict on a sentence without separate opinions is a strong sign that the court intends to stay out of election-related disputes, and that they will leave this to the electoral process in the future writes CNN Supreme Court commentator and law professor. Steve Vladeck.

– Does not meet goals

American researcher Hilmar Mjelde from the Norce research center is not surprised.

– This was as expected. The Trump problem has had neither the facts nor the law on its side in all these frivolous lawsuits. It has been the common thread all the way, Mjelde writes in an SMS to Dagbladet on Wednesday morning.

Mjelde believes this is a clear sign that the Trump gang is fighting a battle that they are not going to win.

– We often see that the nine justices of the Supreme Court ideologically share their vote. When even arch-conservatives Clarence Thomas, Samuel Alito and Amy Baret reject the lawsuit, it emphasizes that the Trump team’s arguments do not hold up, Mjelde writes.

– I’ll see if anyone dares

Before the Supreme Court ruling, Trump issued a clear appeal to the justices.

– Now we will see if anyone dares, whether they are legislators or judges, or if there is a judge in the Supreme Court or several judges in the Supreme Court. We’ll see if they have the courage to do what everyone in this country knows is right, Trump said, according to the Washington Post.

In recent weeks, Trump and his allies have lost about 50 lawsuits to change the outcome of the presidential election, according to the New York Times.

– PR trick

It was on Tuesday that Republican Attorney General Ken Paxton in Texas filed a claim that the Supreme Court should give Trump electoral victory in the states of Pennsylvania, Michigan, Wisconsin and Georgia.

Michigan’s Democratic Attorney General Dana Nessel was clear on what she wanted to say.

– This is a public relations stunt, not a serious legal problem, said Nessel.

“Mr. Paxton’s actions are below the dignity of the State Attorney’s Office and below the dignity of the people of the wonderful state of Texas,” said Nessel.

Biden will be formally elected president of the Electoral College on December 14.
