Mustafa Hasan (18) has been set as a departure deadline of December 7, after spending 13 years in Norway. The lawyer now announces his claim against the state.

– We will sue the state at the UNE and at the same time we will present an application for temporary residence while we have an ongoing legal dispute. Hasan must defend his case from Norway.

That’s what Mustafa Hasan’s lawyer, Nicolai Skjerdal, says. In November, Hasan, who has lived in Norway for 13 years, received a final decision from the Board of Immigration Appeals: He is no longer allowed to stay in the country where he has lived since he was six years old.

The lawyer questions whether Hasan’s case has received adequate treatment.

– We strongly believe that Mustafa Hasan meets the criteria established by the Immigration Law for residence in Norway on humanitarian grounds, he says.

The elements that according to Skjerdal are important in the case are the language and the social and cultural connection. According to the lawyer, the lawsuit will be filed “long before Christmas.” It was NTB who first mentioned the expected lawsuit.

You have requested an extension of the exit deadline

The case has sparked strong participation on social media, and both young people and leading politicians express the need to take a closer look at the legislation that forms the basis for the eviction of 18-year-old Hasan. On Sunday, several people lined up for a demonstration of support in front of the Storting. A fundraiser for Hasan has also generated more than 600,000 crowns.

– This must stop. It can’t happen, Hasan’s support group leader Julia Lysgaard Shirazi told VG during the celebration.

Hasan’s departure deadline is December 7, in just under a week. The lawyer has asked for an extension of the departure deadline, because he believes that it is impossible to bring Hasan safely to Jordan at that time.

– We believe that it is not possible to achieve this for several practical reasons. First of all, you do not have a Jordanian passport and you will not be allowed to enter the country. Second, there are no planes that do not call in any Schengen country to Jordan, as required by Schengen, says Skjerdal.

He adds that the infection situation in Jordan is critical and that it is one of the Asian countries that has been most affected by the pandemic.

– We believe that it is unjustifiable to send him there now. We have therefore asked the police to agree to a delayed departure from Norway. In this case, there is no basis for coercion.

Skjerdal says they have not yet received a response from the Police Immigration Unit to the request.
