According to NBC News, the message comes from federal judge Nicholas Garaufis in New York, who says that the services that Wolf has performed as security minister have been invalid.
– Wolf was not legally employed as Minister of Security under the “National Security Law” when he issued the Wolf memorandum (a memorandum or a specially written message on commercial or diplomatic matters, journal.anm.), Garaufis concludes.

The lawyer in the case and director of the organization Justice Action Center, Karen Tumlin says according to NBC News that the ruling means that “Wolf’s note to stop the Daca program cannot therefore be taken into account.”
Dhaka is a program that protects young immigrants who come to the United States as children from deportation. It was introduced by Barack Obama in 2012 and grants 650,000 young undocumented immigrants, but not citizenship, residence and work permits.
Trump with almost fail
President Donald Trump has tried multiple times to stop the program, but in June a Supreme Court ruling prevented him from abolishing it entirely. In a July note, to which Tumlin refers, Wolf announced that the Trump administration would try to stop the program again, adding that all new applications would be rejected.
He also wrote that the Trump administration would reduce the length of the renewal from two to one year.
“This is a truly hopeful day for many young people across the country,” Tumlin said of Wolf’s new sentence and note, which is now declared invalid.
The sentence can be appealed.

Questions have been raised in the past about the legality of Wolf’s appointment as defense secretary, writes CNN.
According to the channel, the Trump administration has tried to push for Wolf to be confirmed in office before inauguration day. He currently has a functional role in the CEO.
In August, a letter was issued addressing the appointment and pointing out a number of errors in the hiring process, writes CNN.
Wolf has previously been the Chief of Staff to former Security Minister Kirstjen Nielsen and has been employed by DHS since its inception in the wake of the terrorist attacks of September 11, 2001.
