A Polish citizen was granted asylum in Norway after processing complaints at the Board of Immigration Appeals. Both the asylum seeker and his lawyer are surprised, but satisfied.
Human rights activist Rafal Gawel arrived in Norway in January last year with his wife and children. Two days after his arrival, his request for political asylum was rejected by the Norwegian Directorate of Immigration, UDI, to which he immediately appealed.
The Board of Immigration Appeals has unanimously ruled that the complaint must be upheld, writes VG.
“This means that the author is a refugee under the Immigration Act and that he receives a residence permit for one year, which can be renewed and which provides the opportunity for family immigration and to obtain a permanent residence permit later, the author can work in Norway “. .
The court believes that the complainant runs the risk of persecution upon returning to his home country.
– As far as I know, in recent times it has never happened that a citizen of the EU country, Poland, is defined as a refugee and has received protection in Norway. The evidence presented in court was obviously so convincing that they reached this conclusion, says Oslo lawyer Lukaz Niedzielski, who is Gawel’s lawyer.
The head of the department, Marianne Granlund, of the Board of Immigration Appeals, confirms that it is very rare for the court to grant asylum to citizens of European countries.
– But here the documentation was so extensive and the explanation of the complainant so convincing that the court was convinced that he is entitled to protection, he says.
